SHORT TERM RENTAL AGREEMENT
This Short Term Rental Agreement (the “Agreement”) is made by and between Karl and Maggie Schroll (“Homeowner”) and GUEST NAMED IN AirBnB ONLINE BOOKING REQUEST (“Guest”) as of the date last set forth on the AirBnB reservation confirmation. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
Property. The property is located at: Beaver Village Condominiums, 216 Village Drive, Unit 1822, Winter Park, CO 80482. The property is further described as Building 18, unit 1822.
The property is furnished and includes linens, towels, kitchen equipment.
Rental Party: The rental party shall consist of Guest and no more than five additional persons. Guest shall be insure that all members of Rental Party adhere to the terms of this Agreement.
Maximum Occupancy: The maximum number of overnight guests is limited to six persons.
Term of the rental agreement. The rental period is as described in the AirBnB reservation confirmation.
Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.
Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
Rental Rate and Fees
Security Deposit: A security deposit of $250 is due with initial reservation. The deposit is for security and shall be refunded within 7 days of the Checkout Date provided no deductions are made due to:
damage to the property or furnishings;
dirt or other mess requiring excessive cleaning; or
any other cost incurred by Homeowner due to Guest’s stay.
If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately.
Rental Rate and fees are as outlined in the AirBnB reservation confirmation.
Cancellation Policy: If Guest wishes to cancel reservation, the payments will be refunded as follows:
100% if cancelled 60 days prior to the Check-in Date;
No refund if cancelled less than 60 days prior to the Check-in Date. (If home can be re-rented with short notice then refund will be pro-rated based on re-rent although please be aware that 60 days out most families have already booked their vacation plans so few are looking for a vacation house so soon).
Please consider purchasing trip-cancellation insurance.
Payment: Acceptable payment methods are credit cart or e-check submitted through AirBnB.
The parties agree to the terms of this Short Term Rental Agreement, as evidenced by completion by Guest and acceptance by Homeowner of Guest’s online reservation via the AirBnB payment system.
Smoking is NOT allowed in the home or on rear deck.
GUEST PROMISES: The person signing this contract will be present during the entire rental period and is at least 25 years of age (any form of sub-let is NOT allowed).
NO EVENTS of any kind are allowed on the property. This is a HOME in a residential neighborhood and is NOT a hotel and is NOT an event center. Guest agrees to NOT have any type of event at the house, including (but not limited to) Wedding, Stag or Stagette party, bachelor party, bachelor-ette party, or ANY OTHER event.
QUIET TIME: 9 PM until 7 AM is “quiet time” EVERY EVENING!! Guest acknowledges that one of the attractions of this home is its location near the city and the resultant neighbors living in close proximity. All noise including loud talking and music and other sounds will be moved indoors during the hours designated as “quiet time”.
LAUNDRY HOURS: Out of respect for downstairs neighbors, use of the washer and dryer is permitted only between the hours of 9:00 am and 9:00 pm. The HOA mandates a $100 fine for use of the washer and dryer outside of these hours and you will be charged if a complaint is made.
Not to act in a loud, boisterous, unruly or thoughtless manner or disturb the rights of neighbors to peace and quiet, or allow his/her guests to do so;
to use the home only as a private residence, and not to engage in any activity or allow any condition that is illegal or dangerous or which would cause a cancellation, restriction, or increase in premium in Homeowner’s insurance or allow his/her guests to do so;
Not to damage or misuse the home and contents provided by Homeowner or allow his/her guests to do so; that when GUEST moves out, the home will be left in good condition, except ordinary wear and tear. GUEST shall pay for any repairs or replacement, all loss or damage to the house and its contents whenever such damage or loss is beyond normal wear and tear.
GUEST PROMISES: to inform Homeowner IMMEDIATELY if there are any issues with the home. ESPECIALLY with any water leakage or other typical home maintenance issue that may cause substantial damage to the home if not remedied immediately.
DESTROYED OR UNLIVABLE HOME: If the home is unfit to live in due to any cause, Homeowner may choose not to rebuild or restore the home and/or may terminate this rental agreement immediately with no further liability to GUEST. If the destruction or damage was not GUEST’s fault and Homeowner terminates this rental agreement, unused rent will be refunded to GUEST.
GOVERNMENTAL RESTRICTIONS on RENTALS: :If any government unit places a restriction on the ability to rent this property, Homeowner may terminate this rental agreement immediately with no further liability to GUEST. In this event any unused rent will be refunded to GUEST.
MOVE OUT OF THE HOME: GUEST will move out of the home when this rental agreement ends. If GUEST doesn’t move out after this rental agreement ends, GUEST will be liable to Homeowner for any resulting losses including rent and court costs.
People other than those in the Guest party set forth above may not stay overnight in the property. Any person in the property is the sole responsibility of Guest.
Accidents: This home is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
Bicycle waiver: Guest acknowledges that any bicycle equipment on-site is used as-is and that Homeowner and owner are not responsible for any accidents or injuries arising from use of equipment. Guests acknowledge that they have a duty to inspect the bicycles prior to use to assure that it is in a safe and proper condition for use. Guests acknowledge that owners are not present on the property and that Guests are in a better position to inspect the bicycles prior to use, than owners are. Bicycles are for use by the Guests listed above only.
NO LIABILITY/INDEMNIFICATION/HOLD HARMLESS: The owners of the property do not assume liability for the loss, theft, damage or injury (or death) to persons or their personal property. Guests agree to indemnify and hold the owners harmless for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guests’ use and occupancy of the rental property, including but not limited to claims for personal injury or property damage/loss.
Guest agrees to keep the property and all furnishings in good order.
Only use appliances for their intended uses.
PETS are NOT PERMITTED. A fine of $200 per day is mandated by HOA for violation of this rule and you will be charged.
Parking: Parking is limited to 2 vehicles.
Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the units.
Cleaning service: We use a cleaning service between guests that is familiar with the home and they do a great job. If you would like to hire them during your stay please ask and we will provide their phone number.

Our family moved from Stowe, Vermont to Niwot, Colorado in 2014. Lifelong skiers, we purchased our mountain home in Winter Park in October of 2015 so that our children can enjoy the mountain lifestyle that we grew up with. Our kids have been on skis since they first learned to walk, and at ages 4 and 6 love to ski the gentle blues and challenging blue/blacks of both Winter Park and Mary Jane. Our oldest loves the cruisers at Winter Park while our youngest is already sharing our joy of moguls and woods of Mary Jane. We look forward to building a lifetime of memories at Winter Park, and would love to help you build yours, too.
