The city of Palm Springs has a strict noise ordinance. No amplified music. Quiet time from 10 PM until 7 AM. Fines from $500-$750 for noise complaints charged to renter.
• Rental rate includes Transient Occupancy Tax (TOT) of 11.5%. Nightly rent, additional occupancy, added time, and cleaning fee is subject to this tax.
• Short Term Rental Agreement must be completed and signed prior to occupancy (see House Rules for agreement).
• We consider pets on a case by case basis. $50 per pet fee.
• Optional pool heating available at $50 per night, $250 per week (2 night minimum).
• Early check in or late check out is possible on occassion. Feel free to ask and we'll try to accommodate, additional fees apply ($28 per hour includes tax). Otherwise, the check in time is 4pm and check out is 11am on the day of departure.
• Cleaning fee: $220 (includes TOT tax)
• Security deposit required: $500 (held by Airbnb)
• One night minimum. 3-4 night minimum on most holidays.

SHORT TERM RENTAL AGREEMENT
This Short Term Rental Agreement (the “Agreement") is made by and between XXXXX (“Homeowner") and XXXXX (“Guest") as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
Property: The property is located at XXXXX, Palm Springs, CA 92262. The property is furnished and includes full kitchen, 4 bedrooms, 3 full bathrooms, all linens, towels, etc. A starter supply of paper towels, basic cleaning supplies and toilet tissue is provided.
Rental Party: The rental party shall consist of Guest and the following XXXX persons (Names and ages of all guests must be provided):
Additional guests may be added for $28/night/person (includes TOT tax)
Maximum Occupancy: The maximum number of overnight guests is limited to 12 persons (additional fees apply). Renter may not have deposit returned if more than 12 guests are found to have occupied the property during the renter's stay. ‘Over occupancy' is grounds for eviction with no return of deposit or rental fees.
Term of the Lease: The lease begins at 4:00 pm XX/XX/XX (the “Check-in Date") and ends at :00 a.m. XX/XX/XX (the “Check-out Date"). No early check-in or late check-out without prior arrangement.
Optional Pool Heating: Optional pool heating available at $50 per night, $250 per week (2 night minimum).
Minimum Stay: This property requires a 2 night minimum stay unless otherwise arranged with owner. Longer minimum stays may be required during holiday periods.
GOOD NEIGHBOR POLICY: Palm Springs Noise Ordinance no.1848. This home is located in a quiet residential neighborhood with a noise ordinance that is strictly enforced by the local police as well as our pad360 property management team. All guests are required to maintain reasonable and respectful low noise levels - especially outdoors and in evening hours - in consideration of our neighbors. Violation will result in City fines or loss of lease. Any unreasonable noise disturbances resulting in a call to the city or our office from a neighbor, a visit by either the police or our office can result in a minimum $500 charge.
IMPORTANT: The city provides neighbors with a 24-hour hotline to report noise concerns. Loud noise that disturbs neighbors may result in eviction and loss of all monies in addition to a $500-$750 fine. NO amplified music is permitted outdoors anytime day or night.
If a noise complaint is received by the city of Palm Springs from a neighbor, Fine is $100.
If tenant is not reachable by phone within 10 minutes of complaint, Local property manager will be set out to property. Fine for Property Manager being sent out is $250.
If noise disturbance isn't resolved within 30 minutes of initial complaint, fine is $500-$750
This is NOT a party house. Only guests listed in the original reservations are allowed on the premises, no extra guests, no day/night visitors. Daytime and overnight occupancy limits for the home must be followed and are strictly enforced. People other than those in the Guest party set forth above may not stay overnight at the property. No more than 12 people are permitted on the premises at any time. ‘Over occupancy' is considered a serious violation of your rental contract and will result in immediate eviction, loss of lease and forfeiture of security deposit and all rental monies. Any other person on the property is the sole responsibility of Guest.
Access: Guest shall allow Owner or Owner's Representative access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner. Access shall be allowed for weekly pool cleaning (x2) and weekly grounds maintenance (x1). In the event of a noise complaint, owner/ owners representative may enter property to contact Guest, if necessary. If Guest abandons or vacates premises, Owner may, at this option, terminate this agreement, re-enter the premises and remove all Guest's property.
Deposit: The $500 deposit is handled by Airbnb. Deposit deductions are made due to: damage to the property or furnishings, dirt or other mess requiring excessive cleaning, or any other cost incurred by Homeowner due to Guest's stay. If the premises appear dirty or damaged upon check-in, Guest shall inform Homeowner immediately. Furniture may not be moved under any circumstances. iPod tower in living room may not be moved. Moving iPod tower will result in loss of security deposit.
Cancellation Policy: Airbnb strict cancellation rules apply.
Circumstances Beyond Owner's Control: There are no refunds for circumstances beyond the homeowner's control such as construction noise, storms or inclement weather. Homeowner cannot guarantee against mechanical failure of utilities, air conditioning, appliances, TV's and TV equipment, cable and internet. Guest will promptly notify homeowner of inoperative equipment and reasonable efforts will be made to repair equipment efficiently.
Insurance: We encourage all renters to purchase traveler insurance. Trip Advisor's Flip Key program recommends the following: (website hidden)
Payment: Payment handled through Airbnb.
Arbitration. All claims and disputes arising under or relating to this rental contract are to be settled by binding arbitration in the state of California. An award of arbitration may be confirmed in a court of competent jurisdiction.
Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.

Palm Springs quiet time is between 10 p.m. and 7 a.m. The City of Palm Springs prohibits the amplification of sound including music, outdoor speakers, TV's, etc. outside of the dwelling unit and it shall not be audible at the property line. Guest will observe quiet time and keep noise to minimum at all other times. No noise (talking included) should be audible at property line.
Property is Non-smoking. Smoking is NOT allowed inside home. Evidence of indoor smoking = $200 fine. Outdoor smoking is allowed, all cigarette butts must be extinguished and put in trash. $25 fine per cigarette butt found in our yard.
Please be respectful of our property and our neighbors.
Furniture: The furniture, including the iPod tower, may not be moved at any time. Moving of the furniture, and iPod tower will result in loss of security deposit.
pad360 is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises. Guest should be aware that pools and surrounding patios can be dangerous. NO DIVING. NO GLASSWARE is permitted in the pool area. Hard plastic drinking cups are provided for Guest's use in pool area. NO LIFEGUARD on duty.
PETS are considered, please ask BEFORE a reservation is made. Pets are permitted only with prior approval and the Pet Addendum must be completed. $50 per night pet fee.
Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate.
Fireplace: The fireplace is gas/lava rock. NEVER leave children unattended near fire. No items should be placed in fireplace. Gas must be turned off after use. Key and lighter are in kitchen drawer.
Water and Sewer: The sewer system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that other items have clogged the sewer system, you could be charged damages of up to $1000.
Guest agrees to follow departure instructions in the house folder.
