***COVID-19 Info***

Alongside everywhere else, South Padre Island was closed to visitors for over a month as a result of the COVID-19 outbreak.

Recently, the Island reopened and is transitioning back to life. Therefore, we are sharing several important details about the steps we are taking and the overall community in case it is useful.

First, we have ALWAYS maintained high cleaning standards:

- Cleaning crews use masks and gloves
- Linens and towels are washed with bleach
- Surfaces, switches, knobs, and high-touch areas disinfected with Lysol products registered with the EPA on list N.

We monitor recommendations from the CDC and other relevant sources and our cleaning best practices will continue to improve as needed.

Second, since the outbreak, we have adopted several new procedures:

- From time-to-time, depending on the schedule, check-in time may be delayed from 3 pm to 4 pm to ensure thorough cleaning. We apologize in advance!
- Stays of five nights or longer will be prioritized during busiest seasons to minimize the total number of people transiting the condo

Third, you might find the following information useful:

- The Waves is a smaller complex with only eight condos, and all condos restricted to a maximum of six guests
- Our unit has a fully equipped kitchen to prepare your own meals or enjoy take-out
- City beaches are currently open with social distancing restrictions (masks when not swimming, group size limits, structure limits, etc.)
- Bars are closed and restaurants are open with limited capacity or take-out
- There is currently a state-wide mask requirement
- There are currently county wide social distancing requirements, including a 11 pm curfew (10 pm for children)
- Before booking, we recommend that you refer to information published by the City of South Padre Island for the most recent community, county, and state information.
- Rules will likely continue to evolve

**Extra people**

Occupancy on premises is limited to 6 people at all times, including all children. Visitors are OK as long as the total number of people does not exceed 6 and all rules are observed. This is to ensure that all the amenities remain enjoyable by everyone.

**How far is the beach?**

The Waves Complex is located on the corner of Atol Street and Gulf Boulevard (green building on maps). The closest beach access is at Treasure Island which is less than 5-minute walk from the condo.

**Is the beach nice?**

Yes, the beach at South Padre has white sand with dark blue water. While the public beaches do not usually have a closing time, please follow all posted signs. The nearest beach access has on-site restrooms, showers, and trash bins.

**Are pets allowed?**

We welcome non-aggressive, house-trained dogs of specific breeds on a case-by-case basis. All pets are subject to a $99 + tax pet fee and must be approved before booking.

**Is the condo available?**

We keep our online calendars are up-to-date. Simply enter your arrival and departure dates. During certain seasons, we do not permit 1 or 2 nights gaps in the calendar because these nights are almost impossible to fill. If your requested nights will result in a 1 or 2 night gap, then the condo may not be available.

**What is the minimum rental age? Do you allow spring breakers?**

The primary guest making the reservation must be at least 25 years old and staying the entire visit. During certain weeks in the month of March only, responsible groups of student spring breakers age 21+ are permitted. Unfortunately, we are unable to accommodate any other exceptions.

**Is the condo on the ground floor? Are there stairs? Is it handicapped accessible?**

The condo is conveniently located on the ground floor, close to an assigned parking space. There are not any stairs but there is a step-up from the curb. The condo has a walk-in shower in the master bedroom. There are no special handicap features in the condo.

**What is the minimum stay?**

Our minimum stay varies from 2-4 nights, depending on the season. Unfortunately, we aren’t able to accommodate 1 night stays or exceptions to the published minimum stay.

**What is included?**

We provide sheets, bath towels, two beach chairs, various beach toys, various kitchen items, and a starter supply of paper and soaps. Important note: We do NOT provide towels for beach use. Please do not bring bath towels to the beach.

**What is the best available rate?**

We keep our online listing updated with our best available rate. We do not respond to bidding or bargaining requests.

**Is there parking?**

Guests receive assigned parking in front of the condo for 2 cars. The spaces are one behind the other. Unfortunately, additional on-site parking is not available. Please do not park in spaces reserved for other units.

**Rental agreement**

You must submit a signed rental form and agreement within 24 hours of booking. FAILURE TO ACCEPT AND SIGN RENTAL AGREEMENT DOCUMENT MAY RESULT IN CANCELLATION AND YOU WILL NOT BE PERMITTED TO CHECK-IN.

1. Primary Guest/Renter. Guest must be 25 years of age to rent this property. Guest acknowledges meeting this minimum age. As the responsible party, Guest must personally be in residence during the entire stay.

2. Rental Party and Additional guests. The rental party shall consist of Guest and up to five (5) other Additional guests named in this agreement. Guest is required to provide names and ages of all persons who will be on the premises. Guest acknowledges responsibility for the conduct of all persons allowed to remain on the property during the entire Reservation/booking. Minors in the rental party or on premises must be accompanied by a responsible adult at all times.

3. Occupancy Limit. The property has a maximum Occupancy Limit of six (6) persons at any given point in time, day or night including interior, exterior, grounds, driveways, backyard and pool. There are no partial stays for additional guests.

4. Property Use. The Property may be used only for personal vacation purposes. It shall not be used for commercial ventures/publications. Guest may not assign, advertise, sublet, or sublease this short term rental or any part of the property. House parties, social events, and/or ANY activity where additional persons exceeding the occupancy limit are invited, including family reunions, are prohibited.

5. Check-In. Check-in time is specified on the Reservation/booking confirmation from AirBnB on the Check-in Date. If not specified, the default Check-in time is 3:00 p.m. Central. Owner and Owner’s representatives will make a best effort to facilitate on-time Check-in but delays may occur for logistical reasons needed to prepare the unit. For Guest arrivals outside normal business hours, the Owner or Owner’s representatives will provide alternative Check-in instructions. Upon arrival, the property will be clean and set up with the following supplies:

- Bath towels, hand towels, and washcloths. Beach towels are NOT provided.
- Starter supply of soaps, trash bags, paper towels and toilet paper. These items are not replenished during the stay.
- A selection of items in the beach box. Contents may vary and are not guaranteed.

6. Check-Out. Check-out time is 11:00 a.m. on the Check-out date in this agreement unless otherwise confirmed in writing by the Owner or Owner’s representatives. The Guest should complete the following steps at Check-out:

- Leave beds unmade. Place linens and towels in the hallway.
- Wash, dry, and put away dishes, pots, pans, silverware, and utensils.
- Empty refrigerator and clean-up any spills.
- Set air conditioning to 78 degrees or heat set to 55 degrees, per season.
- Put bagged trash in outside receptacles.
- Leave property neat with furnishings in original order. Housekeeping will thoroughly clean.
- Close and lock all windows and doors.

7. Television and Internet. Internet and television service are provided. Specific channels, speeds, delivery mechanism, and selection are subject to change and cannot be guaranteed.

8. Codes and Keys. Primary access to the property is through time-based codes. Keys are generally not provided. If provided, keys must be returned at Check-out. Re-entry to the unit may be delayed for lost keys or codes outside normal business hours.

9. Vehicles and Parking. Parking is provided for a MAXIMUM of 2 passenger vehicles, parked one behind the other in the space assigned to the unit. Each vehicle (except bicycles) operated or parked on premises must have a valid license plate. Guests or vehicle owners must carry sufficient liability insurance for all vehicles operated or parked on the premises. If the space allocated to the unit is improperly occupied by another vehicle, the Guest shall contact Owner or Owner’s representatives and shall not park in any space allocated to other units. Improperly parked vehicles may be towed at the vehicle owner’s expense. Under no circumstances should parking spaces be used for gatherings or socializing, including playing music from vehicles.

10. Pets. Pets are PROHIBITED from the property unless authorized in writing prior to booking. Each pet requires approval at sole discretion of the Owner and must be disclosed in this agreement. Owner may withdraw approval at any time for any reason (including prior to Check-in) and shall not constitute a breach of this agreement. Guest must pay a non-refundable pet fee for the privilege of having a pet at the property. Occupants of the property shall at no time possess any purebred or mix of breeds prohibited by the Homeowners Association. Guest shall carry sufficient liability insurance for all pets. GUEST EXPRESSLY ASSUMES ALL RISK OF ANY HARM ARISING FROM ANIMALS BROUGHT TO THE PREMISES.

11. Rates. Rates, including rent, taxes, and fees, are presented on the Reservation/booking on AirBnB. Published rates are subject to change. No discounts or refunds are provided for rate changes. Rent amount is only for the use of the Property, as defined in this contract. Use of advertised fixtures, furnishings, and amenities is permitted during the Reservation/booking but is not assigned any value unless charged as a specific fee.

12. Changes. Changes to Reservation/booking details requested by Guest are at the sole discretion of Owner and require written approval by Owner. Additional nights or services may result in increased rates, while decreases in nights or services may not result in reduced rates. Amounts paid for dates are not transferable to other dates. All terms from this agreement remain applicable to changed reservations/bookings.

13. Payments. Payments must be made according to all amounts, schedules, and due dates indicated on AirBnB or written instructions from the Owner. Unless otherwise indicated, payments include a booking deposit and payments of any remaining balance. The booking deposit is a percentage of all rents, fees, and damage deposits to hold a Reservation/booking. The booking deposit will be applied toward the rents and fees only and will not be applied towards the damage deposit (see Section herein) unless no remaining balance is due. If full payment of all rents, fees, taxes, and damage deposits is not received according to the required due dates and schedules, the Reservation/booking is void and all prior payments may be forfeited by the Guest.

14. Refundable Damage/Security Deposit. A refundable damage deposit or authorization may be required for this Reservation/booking prior to Check-in as indicated by AirBnB or otherwise in writing from the Owner. The deposit or authorization is for security and shall NOT be applied toward rent, taxes, or fees. Depending on the original payment method, it may take several days after a deposit is released to receive any refund. Owner will release the deposit after Check-out, when all of the following provisions are verified:

- No damage beyond normal wear to the property, furnishings, locks, towels, or contents.
- No items are missing from the property.
- All keys are returned, if provided.
- Presence of unauthorized pets is not detected.
- No extra cleaning is required for excess filth or hair (including from pets).
- There are no violations of this agreement.
- All rents and charges accrued during the stay are paid prior to Check-out.

15. Additional Damage Liability. Guest is responsible and liable for any and all costs due to damage or losses incurred by the Owner that exceed any deposit amount, whether or not covered by Owners insurance. Guest will pay to Owner any amount that exceeds the deposit within five (5) days after Owner makes written demand for such payment with supporting documentation.

16. Cancellations. The cancellation policy is indicated on the Reservation/booking from AirBnB. Any written communication from Guest to Owner indicating intent not to occupy the Property constitutes a cancellation regardless of whether the Reservation/booking is cancelled through AirBnB. Guests who cancel are not entitled to occupy the unit. Cancelled or changed dates may be allocated to another guest, regardless of whether a refund was provided to Guest.

17. Tropical Weather. For safety and property protection, no person may be present at or occupy the Property during periods of extreme tropical weather. Unless otherwise rescinded, for any Reservation/booking with nights included in or closely following either a Tropical Storm or Hurricane watch or warning issued by the National Weather Service for South Padre Island or Cameron County, or a mandatory or voluntary evacuation of South Padre Island ordered by government authorities, the following shall apply:

- All current occupants shall depart from the Property as soon as safely possible, but no later than 12 hours after a warning or watch is issued or at least 12 hours prior to any evacuation deadline. The final night of any Reservation/booking in progress shall be the last night occupied.
- No persons shall arrive at the Property until it has been reopened by the Owner or Owner’s representatives. The first night of any Reservation/booking scheduled to begin shall be the day that the Property is reopened. If no nights remain, then the Reservation/booking is void in its entirety.

18. Refunds. Unless stated otherwise in writing by the Owner, NO REFUND will be given for any change or cancellation by Guest outside the stated policies. Exceptions are at the sole discretion of Owner. No refunds for delayed arrival, early departure, reducing the number of nights, or rescheduling. No refunds for closure or limitations on local amenities, including beaches. No refunds for Guests who are unable to travel, regardless of reason. No refunds for weather except Tropical Weather per Section herein. No refunds for quarantine, shelter-in-place, health or viral pandemic, civil unrest, or other disruptions (including by third-parties) unless a short-term rentals ban is imposed by government authorities. In the event of an applicable Tropical Weather Event or short-term rental ban, Rental Party shall not occupy the Property and Owner will refund pro-rated nightly rent and tax amounts paid to Owner for unused nights during affected dates (fees will be refunded only if all nights in the Reservation/booking are refunded). Damage deposits will be refunded according to the terms of that Section herein. Refunds will be limited to amounts paid to Owner. Under no circumstances will Owner refund service, booking, or other fees paid directly by Guest to a third-party (including AirBnB) and retained by that third party.

19. Personal Information. Personal information provided by Guest for Reservation/booking may be stored and used for related purposes. Guest agrees to receive email, sms (text) messages, phone calls, and other communications prior, during, and after the stay. Guest information may be shared with personnel for these purposes.

20. Furnishings and Equipment. Furnishings are subject to change without notice. Guest should bring any special equipment that is required during a stay. Inspect all furnishings, appliances, and equipment prior to use. Follow all posted instructions for appliances, heating, air conditioning, television, audio, internet, and other devices in the unit. Do not abuse equipment or alter settings. Owner and Owner’s representatives cannot guarantee against mechanical failure. In case of a problem, discontinue use and contact Owner or Owner’s representatives immediately. Owner and Owner’s representatives will make reasonable efforts for efficient repairs or replacement. No refunds for malfunctions. Owner is not responsible for any accidents, injury, death, or property damage resulting from use of furnishings or equipment, unless such is solely due to Owner’s willful action or gross negligence.

21. Outdoor and Pool Amenities. Decks, porches, BBQ grill, courtyard, and swimming pool are provided for the enjoyment of adult members of the Rental party. The beach and open-waters present certain dangers. Children are not permitted in these areas without constant supervision from a responsible adult. Swimming is at own risk. Owner is not responsible for any accidents, injury or death. No refunds for amenities that are unavailable.

22. Rules. Guest acknowledges and agrees to all rules imposed by the Owner or the Homeowners Association as communicated at any time before or during the Reservation/booking. Rules are subject to change. All persons must comply with laws, restrictions, regulations, ordinances, and rules on AirBnB, during the booking process, in this agreement, as attachments to this document, posted at the Property, or communicated by Owner, Owner's representatives, Homeowners Association management, or law enforcement.

23. Illegal Activity. Illegal activity anywhere in or on the property, law enforcement called to the property for any type of disturbance, arrest of any occupants for illegal activity, or any illegal activity observed by Owner or Owner’s representatives is strictly prohibited. No possession of illegal substances or underage drinking.

24. Access and Privacy. OWNER OR OWNER’S REPRESENTATIVES MAY ENTER THE PROPERTY AT ANY TIME FOR MAINTENANCE, EMERGENCIES, OR ENFORCEMENT PURPOSES. ACCESS SHALL INCLUDE, BUT NOT BE LIMITED TO, REGULAR PEST PREVENTION. GUEST SHALL ALLOW MAINTENANCE PERSONNEL ACCESS TO THE PROPERTY FOR THESE PURPOSES. OWNER AND OWNER'S REPRESENTATIVES SHALL EXERCISE RIGHT OF ACCESS IN A REASONABLE MANNER. THIS PROPERTY MAY BE EQUIPPED WITH SECURITY SYSTEMS TO ALERT OWNER, OWNER’S REPRESENTATIVES, HOMEOWNERS ASSOCIATION, AND LOCAL AUTHORITIES TO UNAUTHORIZED ENTRY, FIRE, FLOOD, EXCESSIVE NOISE, VIOLATIONS OF THIS AGREEMENT, AND OTHER HAZARDS. SECURITY SYSTEMS MAY INCLUDE EXTERIOR VIDEO AND/OR AUDIO RECORDING DEVICES PLACED BY OWNER, HOMEOWNERS ASSOCIATION, OR NEARBY UNITS. EXCEPT AS STATED OTHERWISE, OWNER SHALL NOT PLACE VIDEO OR AUDIO RECORDING DEVICES INSIDE THE UNIT (THIS DOES NOT INCLUDE DECIBEL READING DEVICES) WITHOUT PRIOR WRITTEN CONSENT FROM GUESTS. GUESTS SHALL NOT TAMPER WITH, INTERFERE WITH, OR DISABLE SECURITY SYSTEMS WITHOUT WRITTEN CONSENT FROM OWNER. BY SIGNING THIS AGREEMENT, GUEST IS CONSENTING TO ALL SECURITY SYSTEMS AND GUEST ACKNOWLEDGES THAT ACCESS AND SECURITY SYSTEMS AS DESCRIBED DO NOT CONSTITUTE A VIOLATION OF PRIVACY. GUEST AGREES TO ADVISE ALL OCCUPANTS AND INVITEES OF SUCH DEVICES.

25. Falsified Reservation. Exceeding the occupancy limit or falsifying occupancy is strictly prohibited. Any Reservation/booking obtained under false information, including falsifying age, occupancy, purpose of use, or any other false pretense, will result in termination of this agreement, loss of all rents and security deposits, and the party will be evicted or not be permitted to Check-in.

26. Acts of God and Construction Noise. Neither Owner nor Owner's representatives shall be liable for events beyond their control which interfere with Guest(s) occupancy, including but not limited to Acts of God, viral pandemic, acts of governmental agencies, fire, strikes, war, inclement weather and construction noise from nearby sites including other areas of the complex. No rebate or refund will be offered in these circumstances.

27. Guest Property. Owner and Owner’s representatives are not liable or responsible for personal property of the Rental party left behind, lost, stolen, damaged, or destroyed. Owner carries insurance to protect against losses on or to the Owner’s property only. If members of the Rental party leave an item behind and wish to have it returned, Owner and Owner’s representatives will provide reasonable assistance at Guest expense.

28. Guest Insurance. Insurance is not included. Owner encourages all Guests to purchase separate travel insurance. Travel insurance is available at the provider of Guest’s choice. NOTICE: GUEST SHOULD ENSURE THAT THEIR OWN INSURANCE COVERAGE PROVIDES PROTECTION FOR THEIR PERSONAL ITEMS AGAINST ANY LIABILITIES AND LOSSES.

29. Indemnification and Hold Harmless. OWNER IS NOT RESPONSIBLE FOR ANY ACCIDENTS, INJURIES (TO INCLUDE DEATH) OR ILLNESSES (TO INCLUDE VIRUS, VIRUS PANDEMIC OR CONTAGIOUS DISEASE) THAT ARISE OR OCCUR WHILE ON THE PREMISES OR ITS FACILITIES. THE OWNER IS NOT RESPONSIBLE FOR THE LOSS OF PERSONAL BELONGINGS OR VALUABLES OF GUEST. BY ACCEPTING THIS RESERVATION/BOOKING, IT IS AGREED THAT ALL GUESTS ARE EXPRESSLY ASSUMING THE RISK OF ANY HARM ARISING FROM THEIR USE OF THE PREMISES OR OTHERS WHOM THEY INVITE TO USE THE PREMISE, UNLESS SUCH IS CAUSED SOLELY BY OWNER’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. UNLESS SUCH IS SOLELY DUE TO OWNER’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OWNER IS NOT RESPONSIBLE TO GUEST OR GUEST’S INVITEES OR OTHER VISITORS FOR ANY DAMAGES, INJURIES, LIABILITIES, CLAIMS, OR LOSSES INCLUDING BUT NOT LIMITED TO THE FOLLOWING, FOR FIRE, FLOOD, WATER DAMAGE (FROM LEAKS, STOPPAGES, BACK-UPS OR OTHER EVENTS), ICE, SNOW, HAIL, WINDS, EXPLOSION, SMOKE, INTERRUPTION OF UTILITIES, THEFT, BURGLARY, ROBBERY, ASSAULT, VANDALISM, OTHER PERSONS, CONDITION OF THE PROPERTY, ENVIRONMENTAL CONTAMINANTS (E.G. CARBON MONOXIDE, ASBESTOS, RADON, FUNGI, LEAD-BASED PAINT, ETC.) OR ANY OTHER OCCURRENCES OR CASUALTY LOSSES, WHILE ON THE PREMISES. GUEST WILL PROMPTLY REIMBURSE OWNER FOR ANY LOSS, PROPERTY DAMAGE, OR COST OF REPAIRS OR SERVICE TO THE PROPERTY CAUSED BY THE NEGLIGENCE OR BY THE IMPROPER USE BY GUEST, GUEST’S INVITEES, PETS, OR OTHER VISITORS.

GUEST SHALL INDEMNIFY AND HOLD HARMLESS OWNER FROM AND AGAINST ANY AND ALL CLAIMS ARISING FROM OR IN CONNECTION WITH (I) THIS AGREEMENT AND THE USE OF THE PROPERTY AND COMMON AREAS; (II) ANY ACT, OMISSION OR NEGLIGENCE OF GUEST OR ANY OF ITS INVITEES; (III) ANY CLAIMS BROUGHT UNDER PARAGRAPH 24; AND (IV) ANY ACCIDENT, INJURY (TO INCLUDE DEATH) OR DAMAGE WHATEVER (UNLESS SOLELY CAUSED BY OWNER’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT) OCCURRING IN OR AT THE PROPERTY, TO INCLUDE THE COMMON GROUNDS, TOGETHER WITH ALL COSTS, EXPENSES AND LIABILITIES INCURRED IN OR IN CONNECTION WITH EACH SUCH CLAIM OR ACTION OR PROCEEDING BROUGHT THEREON, INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS’ FEES AND EXPENSES. IN CASE ANY ACTION OR PROCEEDING BE BROUGHT AGAINST OWNER BY REASON OF ANY SUCH CLAIM, GUEST, UPON NOTICE FROM OWNER, SHALL RESIST AND DEFEND SUCH ACTION OR PROCEEDING (BY COUNSEL REASONABLY SATISFACTORY TO OWNER). THE PROVISIONS OF THIS PARAGRAPH SHALL SURVIVE THE EXPIRATION OR EARLIER TERMINATION OF THIS LEASE. IF GUEST OR GUEST’S INVITEES CONSUME ALCOHOLIC BEVERAGES AT THE HOUSE, AND ARE LATER INVOLVED IN AN ACCIDENT THAT MAY BE DUE TO SUCH ALCOHOL USE, GUEST SHALL INDEMNIFY OWNER FOR ANY CLAIMS RELATED TO THE USE OF THE ALCOHOL AT THE PROPERTY OR ANY RESULTING LIABILITIES.

30. Force Majeure. In the event that the property is unavailable because it has been damaged, contaminated, sold, or for other reasons beyond Owner control (including but not limited to personnel disruption and mandates from government, Homeowners Association, insurance, or lenders), Owner will notify Guest using the contact details in this agreement. Guest will receive a refund of amounts paid to Owner. Furthermore, the Owner reserves the right to cancel this Reservation/booking for any reason with a refund of amounts paid by Guest to Owner at least thirty (30) days before Check-in date. However, Owner will not be responsible for any costs beyond amounts paid by Guest to Owner. Under no circumstances will Owner refund service, booking, or other fees paid directly by Guest to a third-party and retained by that third party (including AirBnB). See TRAVEL INSURANCE herein.

31. Applicable Law; Jurisdiction; Venue. This Agreement shall be governed by the laws of the State of Texas. The parties agree that they are each subject to the laws of the State of Texas and voluntarily submit to the jurisdiction of the State of Texas, in Cameron County. The parties further agree that the exclusive venue for any dispute arising out of or relating to this Agreement will be a court in Cameron County, Texas.

32. Attorney’s Fees. Unless stated otherwise, the prevailing party in any legal proceeding brought under or with respect to this agreement is entitled to recover from the non-prevailing party all costs of such proceeding and reasonable attorney's fees.

33. Consult Your Attorney. This agreement is intended to be legally binding. READ IT CAREFULLY. If Guest does not understand the effect of this agreement, Guest should consult an attorney BEFORE signing. The common law rule that an ambiguous contract provision shall be construed against the drafter is hereby waived by both parties.

34. Severable Clause. Should a court find any portion of this agreement unenforceable, the remainder of this agreement will not be affected and all other provisions in this agreement will remain enforceable.

35. Violations. Any violation or breach of this Agreement, any rule, or any law or ordinance may, in the sole determination of the Owner or Owner's representatives, result in termination of this agreement, loss of all monies, and immediate eviction, as well as possible legal action/consequences.

36. Right to Refuse Service. By making a Reservation/booking, Guest agrees and accepts all items listed herein and hereby certifies that he/she is at least the age required to rent this property. Spring break student rentals require prior approval. All occupants during Spring Break student rentals in March must be 21 years of age or older. All properties are rented regardless of race, color, religion, gender, national origin or handicap.

37. Holding Over. Guest shall surrender possession of the property upon termination of this agreement. Any possession by Rental Party without written approval from Owner after termination creates a tenancy at sufferance and will not operate to renew or extend this agreement. Guest shall pay $300 per day during the period of any possession after termination as damages, in addition to any other remedies to which Owner is entitled.

38. Written Exceptions/Notices. Any changes or exceptions to the above mentioned policies must be approved by Owner in writing in advance of Check-in Date. All notices from one party to the other must be in writing and are effective when mailed to, hand-delivered, or transmitted by electronic transmission.
