This two story home features high ceiling, french doors, granite counter-tops, rich dark paneled cabinetry, marble bathroom counters, & tile & carpeted flooring. The gated community includes three lakes, a water-park, walking & bicycle trails & more!
This Lease Agreement (“Lease”) is entered by and between Fortune Hill, LLC (“the “Owner”) and (the “Tenant/Guest/Party”) for the period of Check-In Date to Check-Out Date. This Lease creates joint and several liabilities in the case of multiple tenants.
Rental Rules and Guest Information for 5-BEDROOM House at:
Location of Home: “The Lakes" in Menifee, California.
You will be greeted by my Property Manager:
Pearl Anderson: (.CHECK-IN TIME is normally at 3:00 p.m., and CHECK-OUT is normally 11:00 a.m. However, the check-in and check-out times may change according to other incoming reservations. The checkout time can be flexible according to Property Owner and/or Property Managers discretion.
2.PETS are not allowed.
3.STUDENT POLICY – We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult, guardian or parent.
4. NO DAILY MAID SERVICE - While linens and bath towels are included in the home, daily maid service is not included in the rental rate; but is available at an additional rate.
5. PARKING – There is a two (2) car garage, and parking (at no charge) is available for guess on the curve of the cal-de-sac.
6.SMOKING – Smoking is NOT permitted inside the house. However, there is an outside porch where guests can smoke.
7. WASHER/DRYER - The washing machine/dryer in the house is for use of guests in washing your personal items. Towels, sheets or other items in the house will be washed by the housekeeper. Use your personal preference detergent. Leave washer open, upon completion of washing, to dry.
8.GARBAGE - Guests are asked to place garbage daily (or every two days) in the garbage receptacles outside the garage (on the left side of the house). Every THURSDAY is trash pickup day. Please place all receptacles containing trash at the front of the home on the curve/roadside, left or right side of the driveway.
9.PAYMENT AGREEMENT - for the Renter/Tenant/Party – It is agreed that the rate to be charged is US$ amount quoted for your party of up to 9 persons for the check-in to check-out period. In terms of booking requirements, US$ amount quoted due upon booking for your party’s booking period of the check-in to check-out dates. The property is considered booked only after the written agreement is signed / accepted online or emailed with signature and initials, and your payment in full is received. The Payments can be made by: cash, credit card, e-check or wire transfers.
10.DAMAGE FEE- You have paid for property damage protection through the Insurance Provider listed.
11.INCLUSIVE FEES - Rates include full use of all items in the unit, security, plus use of local and nationwide telephone line for Canada, United States of America and U.S. Territories. Twelve (28) bath towels, twelve (28) hand towels and twelve (28) face cloths, along with bath mats are provided in the closet in each bathroom, and within the 3/4 bathroom down stairs, enough for each guest up to 14 persons. A change of linen (sheets / pillowcases) is also provided for each of the bedrooms. Queen sheets are to be used for the sleeper sofa. They can be located in the linen closet upstairs. Please assist us by not sleeping on the comforters and decorative pillows on the beds. Place them in each bedroom’s closet storage area.
Supplies and Material Provisions - The initial supplies provided in the home, once they have been depleted by tenant’s use (toiletries, cleaning supplies and material, etc.) it is then the tenant’s responsibility to replenish/purchase these items for their own personal use.
Mailing Address – The home address at no time is permitted to be used as the tenant’s mailing address.
12.CANCELLATIONS – a 50% refund of their paid rental costs if they cancel at least eight weeks before the start of their reservation. In addition, cancellations made more than thirty (30) days prior to arrival date will incur a $300.00 penalty plus transaction fees (bank, credit card fees and such).
Cancellations or changes that result in a shortened stay, made within less than thirty (30) days of the arrival date, would incur a fee of $500.00 plus transaction fees (bank, credit card fees and such). A 25% refund of their paid rental costs if they cancel up to four weeks before the start of their reservation.
No-shows or early departures do not warrant a refund of unused rental fees.
13. MAXIMUM OCCUPANCY- The maximum number of guests is limited to nine (9) persons. An additional charge of $50.00 per person, per night, for guests in addition to nine (9) will be assessed. This amount will be due prior to accessing and/or vacating the premises.
14. FALSIFIED RESERVATIONS - Any reservation obtained under false pretense will be subject to $250.00 and/or total rental fee, and the party will not be permitted to check-in.
15. WRITTEN EXCEPTIONS - Any exceptions to the above mentioned policies must be approved in writing in advance.
16. COMMUNITY POOL USAGE POLICY and WAIVER OF LIABILITY – The community pools are only permitted to guess that stay for 30 days or more from Monday – Sunday, all day. Pool hours are subject to change. Check with Property Manager. No life guard is on duty. Guess swim at their own risk and covenants not to sue the Landlord or Owner of the house, its officers, employees, and agents, the Lakes community or the Lakes Association from liability from any and all claims including the negligence of the Landlord or Owner of the house, its officers, employees and agents, the Lakes community or the Lakes Association resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in swimming at the Lakes Community Pools.
17.HURRICANE OR STORM POLICY – Full refunds will be given in the case of a storm or hurricane, once the National Weather Service:
a)issues an alert indicating that weather conditions make travel to the destination unsafe:
b) orders mandatory evacuation in a "Tropical Storm / Hurricane Warning area" and / or
c)A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest.
Note that: The day that the National Weather Service orders a mandatory evacuation order in a "Tropical Storm / Hurricane Warning" area, we will refund:
i.Any unused portion of rent from a guest currently registered;
ii.Any unused portion of rent from a guest that is scheduled to arrive and wants to shorten their stay to come in after the Hurricane Warning is lifted; and
iii.Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.
Fortune Hill, LLC., Housing Facilities Exercise Equipment
Waiver of Liability, Assumption of Risk, and Indemnity Agreement
In consideration of being permitted to participate in any way in the use of exercise equipment located within the house located at 30343 Dawnridge Court; Menifee, CA 92584 - owned or - operated housing, hereinafter called "The Activity", I, for myself, my party, my heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant not to sue The Owner of the house, its officers, employees, and agents from liability from any and all claims including the negligence of The Owner of the house, its officers, employees and agents, resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in The Activity.
Assumption of Risks: Participation in The Activity carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another, but the risks range from
1)minor injuries such as scratches, bruises, and sprains
2)major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions to
3) catastrophic injuries including paralysis and death.
I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in The Activity. I hereby
assert that my and my party’s participation is voluntary and that I knowingly assume all such risks.
Indemnification and Hold Harmless: I and my party also agree to INDEMNIFY AND HOLD The Owner of the House, its officers, employees, and agents HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my involvement in The Activity and to reimburse them for any such expenses incurred.
Severability: I, for myself, my party, my heirs, personal representatives or assigns, further expressly agree(s) that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and
Acknowledgment of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I and my party, we are giving up substantial rights, including our right to sue. I acknowledge that I am signing the agreement freely (by accepting this agreement online and voluntarily (by accepting this agreement online), and intend by my online acceptance/signature to be a complete and unconditional release of all liability to the greatest extent allowed by law of the
