Please read our rental contract listed below, by proceeding with booking, you and your guests agree to all terms and conditions of this agreement.

Also, please let us know, prior to booking, if you have children ages 5 and under so we can adjust the quote.

Rental Rules/Regulations/Contract

CHECK-IN TIME IS AFTER 2PM HST AND CHECK-OUT IS 10AM HST

This is a NON SMOKING property. A minimum fine of $300 will be assessed. Smoking is only allowed outside.

PETS ARE NOT PERMITTED IN RENTAL HOUSE UNDER ANY CONDITIONS. Any evidence of pets in the property will incur an extra cleaning fee of at least $200. The property owner assume no responsibility for illness or injury that may incur to pets or humans while on the premises.

DAMAGE/SECURITY DEPOSIT- A damage/security deposit of $300 is required through AirBnB. No claim will requested if:

No damage is done to property or its contents, beyond normal wear and tear.
No charges are incurred due to contraband, pets, and collection of rents or services rendered during the stay.
All debris, rubbish and discards are placed in refuse containers located behind the gate next to the garage.
Dirty dishes are placed in the sink or dishwasher and cleaned.
All doors and windows are closed and locked when you leave so that no rainwater will enter the house and cause damage. If water does enter the house, please wipe it up immediately to prevent damage.
All keys are left on the counter when checking-out.
All charges incurred during the stay are paid prior to departure.
No towels/linens are lost or damaged.
No early check-in or late check-out unless otherwise arranged.
Guests will be charged for broken furniture, broken dishes and glasses and broken appliances. Please treat the property with respect.
All artwork and décor is present and intact.
No Data overages are incurred.
Guests are not evicted by the owner, agent of the owner or local law enforcement.

NON-REFUNDABLE CLEANING FEE – The non-refundable cleaning fee is $120. We may require a larger cleaning fee for extended stays which will be stated in the quote prior to booking.

TAXES - There is a 4% Hawaii State General Exercise Tax (GET) and a 9.25% Hawaii State Transient Accommodation Tax (TAT). These total 13.25% and are included in the rental amount. These taxes are subject to change without notice according to the State of Hawaii stated tax requirements

PAYMENT – Payment will be made through AirBnb and subject to their terms and policies.

CANCELLATIONS – For a 50% refund of accommodation fees, cancellation must be made seven full days prior to listing’s local check in time on the day of check in, otherwise no refund. For example, if check-in is on Friday, cancel by Friday of the previous week before check in time.

MAXIMUM OCCUPANCY – The maximum number of guests is eight. An additional charge of $17 per person per night will be charged for guests in addition to two (2). No charge for first two (2) children ages five (5) and under. Children ages six (6) and older, the additional charge of $17 per person per night applies. Please let us know if you have children ages 5 and under so we can adjust the quote prior to booking.

THIS PROPERTY REQUIRES a three (3) NIGHT MINIMUM STAY.

INCLUSIVE FEES – Rates include a one-time linen setup. Amenity fees are included in this rate.

SATELLITE TV/INTERNET SERVICE – Data Is Limited - Please limit usage to checking email and internet searches. If you stream movies you could go over your allotted data usage amount. The only internet provider available to us in this area is through satellite. We are allowed 10 GB per month. To be fair to all of our guests, we can only allow 1 GB per 3 days or approximately .33 GB per day. If you go over the allotted amount for your stay, you may be charged Data Overage Fees of $10 per GB. We are sorry for the inconvenience and wish we had more internet provider choices in this area. Weather conditions can effect satellite TV and internet service. No refunds will be given due to weather or provider related disruptions.

TELEPHONE – Hawaii and US Mainland calls are free.

PARKING – Parking is available in the driveway for two (2) cars. No parking in the garage.

NO DAILY MAID SERVICE – While linens and bath towels are included in the property, daily maid service is not included in the rental rate. We do not permit kitchen towels, bath towels or linens to be taken from the property.

BEACH TOWELS – We provide beach towels and they are allowed to be taken from the property but they must be returned.

BICYCLE/BEACH/WATER SPORT EQUIPMENT – We offer bicycles, some beach and water sport equipment. Please keep in mind that the ocean can be dangerous, even deadly; there are dangerous sea creatures; there may be rip tides, undertows, and sudden drop offs; “sneaker” waves may overwhelm a person; coral and rocks may be sharp.

We are not always able to inspect any of the equipment between uses. Please inspect the equipment prior to each use to ensure it is in good condition and will function properly; if you detect any defects, do not use it and please notify us so may replace, repair, or remove it. If you are not skilled in the use of the equipment, please seek instruction from a qualified professional. All use of the equipment is at your risk. Remember, Be Safe!

PAPER, TRASH BAGS, SPICES, ETC – Toilet paper, trash bags, dish/laundry soap and basic spices are provided at the start of your stay. You may need to purchase more as needed.

LIGHTS/APPLIANCES – Please turn off lights and appliances to conserve energy whenever you leave the house.

PARTIES are NOT PERMITTED.

RATE CHANGES – Rates are subject to change without notice.

TROPICAL STORM AND HURRICANE POLICY – No refunds will be given unless: The National Weather Service orders mandatory evacuations in a “Tropical Storm/Hurricane Warning” area and/or a mandatory evacuation order has been given for the “Tropical Storm/Hurricane Warning” area of the residence of a vacationing guest. The day that the National Weather Service orders a mandatory evacuation order in a ‘Tropical/Hurricane Warning” area we will refund:

Any unused portion of rent from a guest currently registered;
Any unused portion of rent from a guest who is scheduled to arrive and needs to delay arrival therefore shortening their stay until after the Hurricane Warning is lifted.
Any advanced rents collected or deposited for a reservation that is scheduled to arrive during the Hurricane Warning period.

ACCESS – The owner (Richard S. Marston) or his representative shall have access to the premises for reasonable inspection, repair maintenance or to protect the property and may enter the premises at any time in case of emergency.

FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture advance payment, deposit and or rental money, and the party will not be permitted to check in.

WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved in writing in advance.

INSURANCE - We encourage all renters to purchase traveler insurance.

This house is privately owned; the Owner is not responsible or liable for any accidents, injuries or illness that occurs while on the premises. Guest agree that they are renting and using the property, the area around the property, and any equipment associated with the property completely at their own risk. Guest assumes all risk in using any equipment, such as bicycles, beach/water sport equipment, hammock, pack-n-play, high chair, etc.; the Owner is not responsible or liable for any accidents or injuries that occur from use of any equipment. The Owner is not responsible for the loss of personal belongings or valuables of the guests or their guests.

Guests hereby covenant and agree to indemnify and save Owner and his agent(s) harmless from all claims of injury or damages of every kind and nature, which may occur during the term of the rental period or extension thereof.

By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises and its equipment or others whom they invite to use the premises or any of the equipment.

By proceeding with booking, you and your guests agree to all terms and conditions of this agreement.

Richard's house was amazing. It gave us the family feel while on vacation. Richard was incredible to work with, for he was always available and extremely friendly. We couldn't be more appreciative and satisfied with our stay. Mahalo!!

Everything was just as advertised. We were close to tons of activities, my 3 kiddos (6,4,1 1/2) had a safe and fun environment to be in, and my wife and I hung out on the porch many nights during our 'down' time.

Beautiful ocean view!!! So awesome to just sit on the balcony and take in the breathtaking beauty of the island. Neighborhood is quiet and friendly. The extra amenities in the garage are great. Everything here was just perfect!

This was our first Airbnb experience and Richard couldn't have been more helpful in answering our questions ahead of the booking and providing great information about the location and its surroundings. The house was great for two small family with a total of three small children and the little extras like the full sized highchair, pack-n-play and the swing chair on the deck made our stay. Everything was clean and in order and we have nothing but good things to say about our entire experience. We would stay here again in a heartbeat!

Our stay at Richard's house was amazing. The view was incredible, the accommodations were exactly as promised, and Richard was extremely responsive if a question arose. I would definitely recommend Kohola Hale to anyone staying on the Big Island!
