Terms and Conditions for Fairholme Lake Cottage Rental:
These Terms and Conditions clarify The Owner's obligations to The Renter, The Renter's obligations to The Owner, and in the very unlikely event of any disputes, will be used as the basis for any resolution. Please read them carefully before confirming your booking.
Check-In: 4:00pm / Check-Out: 11:00am
Acceptance of these Terms & Conditions binds a contract between the following two parties:
The Rental Applicant (The Renter) and The Property Owner (The Owner)
1.Party members All persons listed on the Rental Agreement or added subsequently by The Renter will be bound by the terms of this agreement. That the information provided for all guests is valid and true and does not misrepresent age or number of people occupying the cottage at any given time. Occupancy of the Property is restricted to those names listed on the Agreement or added subsequently by The Renter. The Rental Applicant is considered to be the Lead Renter and will assume full responsibility for all guests of the Rental Group throughout the rental period. That the Lead Renter is not less than 25 years old. Information or instructions relating to this rental will be communicated to the Rental Applicant only and not to any third-party member of the Rental Group. The Owner reserves the right to request proof of identity or age for any guest related to this application.
If a Renter brings a visitor(s) to the cottage that is not on the guest list approved by The Owners, the unapproved visitors will be asked to leave; or The Renter may be subject to further charges taken off the security deposit. The Renter agrees the total number of guests will not exceed 10 people, this includes overnight and day guests. Failure to comply with result in a charge of $100 per additional person/per day will be charged.
A reservation will be confirmed by The Owner once the application has been approved and initial or full payment has been processed. For reservations made 4 weeks or more before the rental commences, an initial rental deposit payment of 30% of the rental fee will be due at the time of booking. If a reservation is made less than 4 weeks before the rental commences, the full rental fee must be paid at the time of booking. In the event of a reservation not being accepted by The Owner, all fees paid will be refunded immediately. No reservation may commence without full payment and security deposit being cleared.
Once a reservation is received and accepted by The Owner, The Renter is liable for payment of the balance of the rental fee 4 weeks unless otherwise stated by The Owner before occupation of the Property. In addition, a minimum of $700 security deposit is required 4 weeks prior to the rental dates, unless otherwise stated by The Owner.
Non-payment by the due date will be treated as a cancellation and the deposit will be forfeited. The Owner will provide you with a receipt for all funds paid.
Once payment is received in full, The Owner will send an email a few days prior to your rental dates containing the cottage rules and directions, the lock box code to access the keys as well as a cleaning checklist. When you are ready to vacate the Property, please place the key back in the lock box for the next Renter.
3. Cancellation policy & changing a booking
The Owners are entitled to treat the booking of any Renter as cancelled in the event that:
a) The Renter gives written notification of cancellation to us;
b) The Renter fails to pay the balance of rent by the time specified in the rental receipt.
Once a reservation has been accepted and confirmed, a cancellation can only be made in accordance with the terms below:
- For reservations cancelled a minimum 60 days prior to the rental date, a 100% refund will be given.
- For reservations cancelled a minimum 30 days prior to check in, a 50% refund will be given.
- For reservations cancelled from 0-29 days prior to check in, zero refund will be given
4. Occupancy of the property
Regardless of the published maximum number of persons the Property can accommodate, the number of guests occupying the Property is strictly limited to those named on the Rental Agreement or any subsequent amendment notified in writing to The Owner. The stated and agreed occupancy figure includes all persons irrespective of age, day and overnight guests.
The Renter agrees the total number of guests will not exceed 10 people, this includes overnight and day guests. Failing to abide by these rules will result in immediate eviction without refund, or a $100 per guest per day charge at the discretion of The Owner.
If failure to comply with the maximum number of allowable guests results in septic malfunction or sewage backup, the Renter will be
fully responsible for all damages or repairs caused by the overuse. Furthermore the Renter will be responsible for loss of future rental
income should repairs or damages interrupt or cancel potential or already confirmed rental dates.
5. Condition of the property
The Property will have been inspected prior to occupation and therefore The Renter undertakes to:
- Notify The Owner immediately with regard to any damage and/or maintenance issues that require attention.
- Keep the Property and all furniture, fixtures, fittings, chattels and effects in or about the Property in the same state of repair
and condition as found at the commencement of the Rental.
- To replace any part of the Property or the furniture, fixtures, fittings, contents and effects which are damaged, destroyed, lost
or stolen with similar articles of at least equal value or pay to The Owners the value of such Property that has been destroyed,
damaged, lost or stolen.
- To vacate the Property at the end of the rental and to leave it in a clean and tidy condition. Failure to vacate the Property by
the specified checkout time can result in an additional fee of $125.
- The Renter agrees to remove all garbage and recycling, a $50 charge will apply per bag/container that has not been removed.
- A laundry fee of $50/per load will apply should linens, bedding, or towels require cleaning.
- Where a cleaning service is provided; The Renter shall remove all personal contents, and make reasonable effort to leave the
cottage in clean state for the cleaning service to complete their duties, this includes removal of garbage and recycling. If the
cleaning service must spend more than 1.5 hours to clean after your departure you will be charged $50 for each additional ½
hour it takes to clean the Property to its original state.
- Where a cleaning service is not provided; The Renter shall leave the Property in the same state of cleanliness and general
order in which it was found. To follow the departure instructions listed in the Cleaning Checklist provided by The Owner.
- Failure to do so to the satisfaction of The Owner will result in a damage/cleaning charge being levied. Should the cottage be
left unclean, The Owners have the right to charge an initial cleaning fee of $125 in addition to any costs associated with loss of
future rental. If the cleaning service must spend more than 1.5 hours to clean after your departure you will be charged $50 for
each additional ½ hour it takes to clean the Property to its original state.
6. Use of telephone and internet services
Where a telephone is provided as part of the rental, The Renter must charge all long-distance telephone calls to either a credit/phone
card or call collect, unless advised otherwise. Where internet services are provided, there may be download restrictions and a charge
may be levied if these are exceeded. It is The Renter's responsibility to check for restrictions on an internet device before commencing
Two dogs are permitted however must remain within Property boundaries even if they are unleased. Failure to abide by the
Municipality of Whitestone by-laws can result in a fine or your dog(s) being impounded. Dogs are not allowed to wondering freely or
allowed on private property of neighbouring cottages. It is recommended your dog(s) are leashed or chained when outside during the
duration of your stay.
Dogs are not allowed on beds, couches or any other type of furniture. All evidence of pet occupation must be removed from the Property and grounds at the end of the rental period. All dogs must be housebroken, should your dog urinate/defecate/vomit/mark on any furniture/flooring/carpets/rugs you will be responsible for professional cleaning or replacement of such item. If left unattended in the
cottage a crate is provided for your use.
You guarantee your dog(s) is up to date with shots and administered anti flea treatment prior to rental dates. Failure to treat your dog prior to the rental dates and the results are a flea infestation you will be charged the cost for pest control, and loss of rental income to correct the issue. Should excessive barking lead to noise complaints by others, or neighbours, The Renter agrees to forfeit the rental and the balance of the rent and vacate the Property immediately. Or find alternative living arrangements for your dog(s) for the remainder of the rental period. Should your dog(s) damage any of the Property you will be fully responsible for said damages. Exceeding the 2 dog maximum without written permission will result in a $150 charge.
Smoking is not permitted inside the cottage, sunroom or on any deck. Please dispose of all cigarettes in the appropriate manner. A $700 charge will apply if smoking has occurred in any these locations. Failure to dispose of cigarettes properly will result in a cleanup fee of $125.
9. Property access during winter months
The Property may be offered for rental during the winter months and has road access and receives a snow clearance service from Municipality of Whitestone. However, Renters are advised that following any major snowfall, snow plough providers are contracted to clear local roads in a predetermined order. Consequently, plowing at a Property may be delayed for several hours or, in severe storm conditions, days. In the unlikely event that a Renter is unable to leave a Property on the planned departure date, The Renter will not be liable for any additional accommodation charges. Conversely, should a lack of snow clearance prevent a Renter from reaching a Property, The Renter will receive a refund of the rental fee for the day(s) the Property was inaccessible. However, The Owner will be held responsible for any losses, additional expenses or penalties incurred as a result of being unable to arrive at or leave a Property on time due to a lack of snow clearance. Renters are also reminded to ensure that they and their vehicles are suitably prepared and equipped for driving in the wintry conditions likely to be encountered during their visit to the Property.
10. Equipment and facilities provided
Equipment and facilities are provided at the discretion of The Owner and whilst every attempt is made to ensure that such equipment is in working order for the duration of the rental period, should a breakdown or some other situation occur that renders non-essential element unusable, The Owner does not take responsibility for replacing or refunding The Renter for the lack of use of these equipment or facilities. The equipment and facilities referred to include (but are not exclusive to) such items as watercraft, motors, televisions, VCRs/DVDs.
The Renter must report any inoperative or defective equipment to The Owner promptly. The Owner will make every reasonable effort to
have repairs made as soon as possible; however, there are limited service contractors in Whitestone Municipality. While every attempt will be made to ensure that all the advertised equipment and appliances are in working order at the commencement of a rental period, no reduction of rent; rebate; or refund will be issued for a mechanical failure of appliances, including microwave, BBQ, dishwasher, washer, dryer, TV, blu-rays, stereo, satellite dish or any other appliance.
If a breakdown should occur to fundamental elements such as water systems, plumbing and electrical systems, and major appliances
such as stove or refrigerator, every effort will be made to repair or replace, or an appropriate refund will be made for the inconvenience caused. This does not apply to system breakdown caused by misuse, such as plumbing blockages caused by inappropriate use (which includes exceeding 10 people limit) of sanitary facilities.
The Owner is not liable, nor will provide a refund, for any stoppage of electrical services caused by extreme weather or other circumstances beyond our control. Similarly, there will be no refunds for inclement weather, changes in water levels, conditions at neighboring properties, or any nuisance afforded by the natural elements of the location such as bugs, insects or the animal population.
12. Security Deposit
The Owners, shall be entitled to collect a returnable deposit as security for the observance by The Renter of his undertaking and of the conditions of the Rental. The Owners reserves the right to be the final arbiter in any damage claims made by The Owners and determine the amount of any full or partial payment to The Owners made from this deposit. The deposit may also be used to pay for
any unauthorized long distance telephone calls, made during the period of the rental and/or utility costs where this is a condition of the rental. In addition, The Owner may request for additional funds above the security deposit to be used for cleaning services, laundry fees, damages or replacement of contents, including furniture, fixtures, fittings, chattels due to misuse during your rental period.
The security deposit shall be returned within 10-14 days, in the form of a refund back onto credit card, or email transfer after The Renter has departed from the Property and The Owners (or his representative) has had an opportunity to inspect it for any damage, cleanliness, and contents are in the same state as when originally rented.
13. Access to the Property
The Owners, or their representative, shall be allowed access to the Property at any reasonable time during the rental period for maintenance, emergency or if there is reason to believe The Renter is not adhering to the terms and conditions of the rental contract, noise disturbance, inappropriate or illegal activity is occurring in or on the Property.
14. Fire Regulations
The Renter takes full responsibility for any fire that is lit in the wood stove or outside of the cottage, and agrees to never leave a fire unattended. Any damages to the Property and surrounding areas caused by a fire will be the full responsibility of The Renter. Renters agree to call the toll free numb for the daily fire danger ratings prior to lighting any fire and agrees to follow all bylaw regulations. Failure to extinguish a fire properly will result in a $700 fine.
15. Credit Check
The Renter is hereby notified that a consumer report containing credit and /or personal information may be referred to in connection
with this transaction.
16. Other Conditions of Booking
The Renter shall abide by these Terms and Conditions of Rental and any other instructions contained in the individual Cottage Guide and any additional information and instructions as shall be supplied in the Property or by The Owner. If The Renter's standard of behaviour is such that it leads to repeated complaints by others, or neighbours The Renter agrees to forfeit his rental and the balance of the rent and to vacate the Property immediately.
LIMITATIONS OF LIABILITY: The Renter represents, warrants, acknowledges and agrees with The Owner that he/she will use the
Property and its facilities in accordance with The Terms and Conditions above and the information provided whether written, verbal or is
included in subsequent documentation and that he/she does so at his/her own risk. The Renter agrees to indemnifies and saves The Owner harmless from any personal injury, sickness or death, loss or damage, however caused, to person(s), or Property of The Renter, his/her family members, pets or guests, before during or after the time of occupancy. Further, The Renter will accept full responsibility for the use of the Property and any recreational equipment such as boats and motors, etc. and agrees to pay for any damage of said equipment, other than for normal wear and tear. The Renter further acknowledges he/she is responsible for ensuring all Boating
Regulations are observed, including having required life jackets and safety equipment in the watercraft, as well as meeting current Operator Competency Requirements.
