1. AGREEMENT: The Owner and Tenant agree as follows: Above Tenant is an adult and will be an occupant of the home during the entire reserved period. Other occupants will be family members, friends or responsible children. Use of the premises will be denied to persons not falling within the forgoing categories and as a result they would have to vacate the property immediately without any refund. No keys will be issued to anyone who is not an adult.
2. UTILITIES: With the exception of gas and electric consumption charges are included for stays up to 28 nights. On stays 29 nights or greater, Tenant is responsible for actual gas and electric consumptions charges. The amount to be charged will be calculated based on the reading of the gas and electric meters upon check- in and check- out and it will be discounted from the security deposit unless otherwise agreed.
3 A. FIRE-PIT: Use of the fire pit is limited to three hours per day. If use of the fire pit exceeds three hours, the tenant will be charged $50 for every hour of additional use.
3 B. SECURITY SYSTEMS: If any of the security systems are found to be tampered with, turned off for any duration, or used in any unauthorized way, no less than $1000 will be taken from the security deposit(URL HIDDEN) 3 C. Owners of Via Acero St. Malibu are allowed to go inside their home for any emergency, noise nuisance, for any good reason. 3 D. The traveler/tenant has the right to view or not view our property before check in. No rights to complain after checking into Bouganim Villa/Home(URL HIDDEN) 4. PARTIES AND EVENTS: Parties and/or events of any kind are strictly prohibited at the house. No party or event may take place without prior written permission. In the event that a non-authorized party or event takes place at the property, Tenant risk(URL HIDDEN) Forfeiting part or all of the security deposit in addition to any costs associated with legal remedies that may be necessary.
5. NOISE: As stated in the Malibu Municipal Code, no external or internal excessive noise is allowed between the hours of 10 pm and 7 am unless otherwise permitted by the city. Tenant risks forfeiting part or all of the security deposit in addition to any costs associated with legal remedies that may be necessary associated with any and all noise complaints.
6. PARKING: Parking on the street or the neighbors driveways is strictly prohibited. The house is on a narrow road and has PLENTY of driveway parking. For this specific rental agreement, a maximum of ___ cars will be parked on the property.
7. ADDITIONAL OCCUPANTS: If more than the agreed to number of guests are staying at the property. Tenant takes the risk of forfeiting up to the entire amount of the security deposit.
8. SMOKING INSIDE THE UNIT IS STRICTLY PROHIBITED: Tenant risks forfeiting part or all of the security deposit in addition to any costs associated that may be necessary.
9. FILMING: The filming of any still or motion pictures in any format that requires more than 2 persons and/or any specialized gear, apparatus or crew is strictly prohibited unless prior written authorization is obtained. Failure to obtain written authorization may result in full deposit forfeiture.
10 PETS: Pets are allowed only with prior consent and written approval. For this specific rentalagreement, ____ pets are allowed. Applicable pet fees are included in section four of this agreement. An additional pet deposit within the security deposit may be required.
11. SECURITY DEPOSIT: The security deposit will be returned to the tenant within 2 weeks after check-out date provided that real and personal property are in the same condition as when occupancy commenced and all terms of this agreement are met. Tenant is liable for all replacements and repairs that are outside what is considered normal wear and tear. If something after the rental is deemed not in good order, an amount of money will be removed from the security deposit.

13. CANCELLATION: Should you wish to cancel this reservation, notice of cancellation MUST BE IN WRITING AND RECEIVED MORE THAN 45 DAYS PRIOR TO YOUR CHECK IN DATE. We will refund the sums you have paid, less a $500 cancellation fee.
14. CHECK IN: Any time after 2p.m. Check-In Time, Keys will be provided at property location.
Keys WILL NOT be issued with a balance owing or without a signed rental agreement in the owners, or owner s reps possession.
15. CHECK OUT: 12:00 P.M. The request for a late check-out is made within 24 hrs. prior to the departure date stated in the agreement. Charges for a late check-out time, 25% of the current nightly rate,will be made against your security deposit
16. Cleaning: The Villa will be inspected and cleaned after your departure. The cleaning fee you have paid will cover this. If additional cleaning is required, appropriate charges will be deducted from your security deposit at the rate of $20 per hr.
17. WHAT WE SUPPLY: The property is equipped and set up as a fully furnished property that will include all linens, as well as a fully equipped kitchen. THERE WILL BE EXTRA CHARGES TO YOUR SECURITY DEPOSIT FOR REPLACING THESE ITEMS.
18. WHAT YOU SHOULD BRING: Plan on packing your personal toiletry items. We provide a limited supply of toilet paper, paper towels, & other dispensable items to get you started onyour first day of vacation.
19. TENANTS LIABILITY: Tenant agrees to accept liability for any damages caused to the property (other than normal wear & tear) by Tenant or Tenants guests, including but not limitedto landscaping, misuse of appliances, equipment furnished. If damages are in excess of the security deposit being held, Tenant agrees to reimburse owners for costs to repair/replace
20. HOLD HARMLESS: Owners do not assume any liability for loss, damage or injury to persons or their personal property.
21. JACUZZI TUBS, SAUNA, WALKWAYS, GAS FIRE PIT, & BALCONIES: The undersigned is fully aware that these can be dangerous, that the walkways/balcony & areas can be slippery when wet, & that injury is likely to occur to anyone who is not careful. With full knowledge of the above facts & warnings, the undersigned accepts & assumes all risks.
22. ADDITIONAL TERMS & CONDITIONS: The undersigned for himself/herself, assignors, executors, administrators fully releases & discharges Owner from any claims, demands & causes of action by reason of any injury, or any of his/her guests as a result of or in connection with the occupancy of the premises & agrees to hold the Owner free and harmless of any claim or suit arising there from.
23. PERSONAL PROPERTY LEFT BEHIND: Any items left behind will be mailed back upon request. The cost of shipping will be deducted from the security deposit.
