Even closer is the beach, with soft sands and gentle waves just seconds away. Afterwards, soak in the building's shared hot tub and swimming pool, complete with nearby shared grills for barbecues.

You'll be impressed when you step inside this third-floor condo. Cool marble tile on the floor lets you relax your feet, as you kick-back on leather sofas and enjoy the carved wooden furnishings around you. The occasional painting completes the elegant atmosphere, as does the views on the nearby balcony. Sit back, relax, and enjoy modern entertainment, from cable on the flatscreen TV to music streaming thanks to the wireless internet.

The nearby kitchen has everything you need to whip up delicious meals, including shining marble countertops, dishware packed into cabinets and wine racks, and all the basic appliances. There's a table indoors for up to eight guests, as well as a balcony table for four.

Leave the dishes to the dishwasher and head off to bed. Two bedrooms - each with a queen-size bed - allow up to six guests to stay in this home, though four will have the most comfort. There's even room for one dog of up to 35 pounds to accompany you, for a small nightly fee.

This Rental Agreement (this “Agreement”) constitutes a contract between the undersigned individual (“You” or “Guest”) and San Andres Condominiums, L.L.C. (“Owner”).

Reservation Requirements and Full Payment.  You must be at least 24 to rent any property at San Andres Condominiums.   Reservations are not considered “guaranteed” until Owner receives your completed Rental Agreement and receives and accepts the required deposit and full payment.  If the Rental Agreement and full payment is not received and accepted by Owner at least 30 days prior to your arrival, your reservation is subject to cancellation.   An advance payment equal to 50% of the rental rate is required 60 days before arrival.  The remaining rental balance is required 30 days prior to arrival. If your reservation is made inside of the 60 day window, full payment is due at the time of the reservation.  You agree that Owner may charge your credit card on file for the remaining balance after deposit if you fail to provide the required payment 30 days before arrival.  If the payments are not made within 24 hours of the due dates, the reservation will be canceled without refund of previous payments. Rental rates will include the quoted rate, pet fees, and local and state taxes.  Extra housekeeping fees, early arrival and late departure fees and damage assessments, when applicable will be charged to your credit card after departure.  All reservations require a credit card or debit card, a signed rental agreement, a valid credit card, and a current driver’s license for ID purposes.  Cash, personal and business checks are not an acceptable form of payment.

Security Deposit.  By paying the security deposit referenced above, you are accepting the terms and conditions of the rental contract. The security/damage deposit is NOT applied toward rent but is fully refundable within 7-10 BUSINESS days of departure.  However, when damage occurs, the owner reserves the right to return deposits up to 30 days after departure.  If damages exceed the deposit amount, Guests will be responsible for charges in excess of the deposit and the damage amount will be charged to your credit card on file. Failure to abide by the rules, terms, conditions will result in forfeiture of your deposit, rental money and fees and/or eviction from the premises.

Accepted Forms of Payment.  Owner accepts MasterCard, Visa, Discover or debit cards.  Payment of deposits must be by credit card.

Deposit to Secure your Reservation.  You must pay a reservation deposit when making your reservation in the amount of $300.00 or one night of the cost of your vacation rental, whichever is greater, which converts to your security deposit upon arrival.  You waive all rights to bank account interest that may accrue on your deposit.  By submitting this Rental Agreement, you are accepting all terms and conditions of the rental agreement set out herein and the Rental Policy attached as Exhibit A. 

Confirmation of Reservation(s).  Confirmation of your reservation will be emailed to you.  Please read the confirmation for accuracy of dates, mailing address, number of adults and/or children and accommodations.  You must notify Owner of any errors within one business day.  Guest is fully responsible for any errors which are not brought to the attention of the Owner within the time prescribed.

Additional Security Deposit.  Owner reserves the right at its discretion to charge an additional security deposit at the time of reservation in the amount of $300.00 or 15% of the total payment, whichever is greater.  This deposit will be refunded in whole or in part at Owner’s discretion after your departure and an inspection of the premises by Owner.  

Cancelation and Refund Policy:    Reservations canceled prior to 60 days from arrival date will be subject to a $100 cancelation fee.  Reservations canceled 60 days or less prior to arrival date will result in a 100% forfeiture of the reservation fee (deposit).  Reservations canceled 30 days or less prior to arrival date will result in a 50% forfeiture of the total rental amount including the reservation fee.  Reservations canceled within 14 days of arrival date will result in a 100% forfeiture of rental amount and the reservation fee. Inclement weather will not be considered a valid reason for a refund.  For Guests that rent for the months of January, February, or March (30 days or more) cancelation is required by October 1st. If your reservation is canceled after October 1st, this will result in forfeiture of your deposit. The only exception would be a forced evacuation of the island due to a hurricane.  If you vacate the property early for any reason or are evicted you will not be entitled to a refund.   Owner strongly recommends all renters acquire adequate vacation cancelation insurance prior to signing any rental agreement.

Guests and Maximum Occupancy.   -   THERE ARE NO UNREGISTERED GUESTS ALLOWED ON THE PROPERTY -  Your reservation is confirmed for the number of Guests provided by you. You must send a Guest list within 48 hours of making your reservation. The key code will not be activated if the list of Guests is not provided in a timely fashion as required herein.  The Guests are subject to immediate eviction without benefit of any refunds of rental fees or deposits if more Guests than listed are present on the property. Maximum occupancy per unit is 6 Guests. Invitation of non-resident Guests to parties, weddings, family reunions, etc. is strictly prohibited without the written permission of Owner. The persons whose name is on the rental agreement must be a Guest. Subletting is not allowed. Owner or its representatives may enter the property at any time, without notice, for the purposes of protection, and/or maintenance of the property.

Excessive Wear and Tear; Damage.  You are responsible for rental charges for the full duration of the reservation and for any damages or breakage to the rental property incurred during the rental period, even if a security deposit has been paid.  Owner may charge the credit card on file for any damage or breakage or excessive cleaning costs incurred during the rental period. Excessive cleaning fees will be assessed if the property is left in extremely dirty condition beyond normal wear and tear. The decision to charge the excessive cleaning fee is at the discretion of the Owner.

Agreement to Comply with all Rental Regulations.  You and any Guest in your unit(s) must comply with all of the Rental Regulations set forth on Exhibit A to this Agreement (the “Rental Regulations”).  Failure to comply with the Rental Regulations and any reservations made under false pretenses may result in loss of all your payments made to Owner and possible removal of you from the rental property, in addition to all other remedies available to Owner.  If you violate any of the conditions of this Agreement or the Rental Policies, Owner may enter the rental property and you agree to vacate the rental property immediately upon the request of Owner and forfeit all rent paid. 

Assumed Risks for Hot Tubs and Swimming Pool.  You assume all risks related to the use of the hot tub and Swimming Pool including any illness or injury.  The Hot Tub is not recommended for use by children or pregnant women.

Mechanical Failures.  Owner cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, hot tubs, audio visual equipment, computers or internet access, television or appliances.  Please report any inoperative equipment to Owner immediately.  Owner will make every reasonable effort to have repairs done quickly and efficiently.  No refunds or rent reductions will be made due to failure of such items.

Acts of God.  Owner shall not be liable or deemed in default under this Agreement for any failure to perform or delay in performing any of its obligations due to or arising out of any act not within its control, including, without limitation, acts of God.

Indemnification and Hold Harmless.  You, individually and on behalf of all of your Guests, agree to and does hereby indemnify and hold harmless the Owner, its employees, agents, representatives and assigns, from any and all claims, liability, and injury to person or persons upon the Property from any cause whatsoever. This full indemnification includes and is not limited to any and all suits, injury, costs, losses, action, court cost, attorney fees, penalties and damages of any kind, however caused (except for willful gross negligence) and any expenses arising from or related thereto; from the Guest’s rental, use and enjoyment of the Property during the term of the contract. Once the Rental Agreement is signed, you are considered a Guest and will adhere to all the terms and conditions of the contract.   By submitting the Rental Agreement, you agree that you have read, understand and agree to abide to all terms and conditions in the Rental Agreement.    You agree that any violation of these rules will result in eviction with no refund.  You further agree that the costs of extraordinary cleaning, excessive removal of garbage, missing furnishings, and damages will be deducted from the security deposit or charged to my credit card. By submitting this Rental Agreement, you authorize San Andres Condominiums, LLC, to charge your credit card for any damages, excessive cleaning or early arrival and/or late check-out fees.

Governing Law; Venue.  This Agreement and all transactions contemplated by this Agreement shall be governed by, and construed and enforced in accordance with the laws of the State of Texas.  Any civil action or legal proceeding arising out of or relating to this Agreement shall be brought in the courts of record of the State of Texas in Cameron County.

Entire Agreement.  This Agreement and Exhibit A represent the entire understanding and agreement between you and the Owner with respect to the subject matter of this Agreement, and supersedes all other negotiations, understandings and representations (if any) made by and between such parties.

The following must be completed.  Payment of deposit does not exclude this requirement.

You are providing your credit card number as a guarantee of payment to Owner and agree to pay all rent and charges related to rental property.  You accept all terms of this Agreement and accept all liability for rent and charges related to property rental, as well as any damage beyond normal wear and tear.  You understand that these costs will be charged to your credit card.  In the absence of another payment arrangement, you authorize Owner to charge your credit card for payment of these items.  Once the credit card or other authorized form of payment is accepted, you have agreed to all terms and conditions and agree to be bound by the terms of this agreement.(URL HIDDEN)

Check-In/Check-Out Times.  Check-in time is after 4:00 p.m.  Check-out time is 11:00 a.m.  In the event of a late departure not previously approved by Owner, you will be charged an additional night’s rent.  Do not attempt to enter the unit prior to your arrival time even if it looks like the cleaning crew is finished.  Check out includes the entire property, all common areas and pool side area.  Upon check out, if you are going to stay on the island that your vehicle is removed from the property for the next Guest.

Minimum Stays.  Depending on the season your reservation must be for a minimum number of nights.  For Prime Season the minimum stay is 3 nights.  For Fall and Special Seasons the minimum stay is 2 nights, except for Christmas/New Year’s which is 3 nights minimum.

Standard Amenities.  All rental properties include washer/dryer, dishwasher, microwave, 3 TV’s with cable or satellite, 2 DVD player, and kitchen. A basic supply of towels and linens is provided in each condominium rental.  Bed linens and bath towels are not changed during your stay.  House cleaning services may be arranged at the Guest’s expense by cal(PHONE NUMBER HIDDEN).

Provided Starter Supplies.  For your convenience, you will find a starter supply of paper towels, dish soap, dishwasher detergent, toilet paper, shampoo and bath soap along with basic cleaning supplies such as sponge, glass cleaner and anti-bacterial wipes already in the condominium rental.  You must purchase any required additional supplies.  The kitchen is not stocked with staples or spices.

Internet Access.  High-speed Wi-Fi Internet access is provided.

No Daily Maid Service.  Owner’s cleaning staff will ensure that your rental unit is clean upon your arrival.  If your rental unit cleanliness upon your arrival does not meet your expectations, please contact Owner immediately.  Owner does not provide daily maid service.  However, arrangements can be made for a house cleaner during the course of the rental at the Guest's expense. Furnishings.  Furnishings are subject to change without notice.  Furniture, bedding, mattress pads, kitchen equipment, utensils or any other property supplied with the rental property must not be moved, taken out or transferred from one rental property to another.  Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to you.  Each property is inspected by Owner staff at the conclusion of your stay.  All contents of the home are the property of the owner.  If something should break, you must notify Owner immediately so that a replacement can be made.  Guests are not permitted to alter the wiring of any television, home theatre or gaming equipment.

Pets.    Pets (DOGS ONLY – NO CATS ALLOWED) are allowed with the express approval of the Owner and only after the payment of an additional deposit of $200.00 for the first pet and a $50 deposit for each additional pet up to a total of 2.  There is a $75.00 non-refundable fee for any pets on the premises.   Any guests who bring unregistered pets will face immediate eviction and forfeiture of rental payments and damage deposits.  Pet deposits, over and above the $75.00 non-refundable fee, are refundable within 7-10 BUSINESS days after departure provided there is no damage to the unit or common areas.  Guest bringing pets on the Property must comply with the following pet rules:

All pets must be up to date on rabies vaccinations and all other required vaccinations
Pets must be leashed at all times when out of the rental unit.
Guest is responsible for all pet refuse.
Pets are to be treated with a topical flea and tick repellant at least three (3) days prior to arrival.  
Pets are not allowed on the furniture.  Any evidence of pets on the furniture will result in the forfeiture of the entire pet deposit and may result in the forfeiture of the rental deposit.  Excessive damage over and above the amount of the deposits (rental and pet) will be charged to the Guest’s credit card on file.
Excessive noise by any pets which disturb neighbors and other renters may result in eviction from the Property.
Pets shall not be left unattended for any length of time, indoors or outdoors.
Pets shall not be left unattended on the balcony or porch.
The Owner assumes no responsibility for illness or injury that may occur on the Property to humans or pets.
Pets are not allowed in the pool area.
Guests are solely responsible for their pets while on the Property.  Failure to comply will result in forfeiture of the security deposit, pet deposit, damage charges and possible eviction from the Property.  

Parking.  Each rental property has a rated maximum number of cars permitted.  You will be assigned a parking space and should use only the space assigned at all times during the rental period.  Guest will place parking permit in the dashboard of their car. Vehicles without parking permits will be towed. Tents, campers, or motor homes are not permitted on the property. Trailers may be allowed, but ONLY with prior approval from Owner. Owner is not responsible for any fees associated with towing or disablement of any vehicles owned or operated by Guests on the property.  Once you have checked out of the condo you must also remove your car from property so the next Guest will be able to park in their appropriate parking spot and avoid towing. Parking on the grass is not prohibited and may result in loss of deposit and any charges incurred in replacing landscaping and/or sprinkler system repair. 

No Smoking.  All rental properties are nonsmoking, no exceptions.  No smoking is allowed anywhere on the rental property.  Upon check out, if smoke smells are detected inside the condominium, security/damage deposits will be forfeited. Extra fees will be charged to remove the smoke smell from the unit. 

Pool. The pool is open to Guests from 9:00 a.m. to 10:00 p.m.  GATE MUST REMAIN CLOSED AT ALL TIMES (this is a city ordinance). Please rinse sand off in the outdoor shower before entering pool. Guest is allowed to use the common area, provided trash and belongings are removed when not in use. NO glass is permitted in the pool area including the outdoor kitchen. THERE IS NO LIFEGUARD ON DUTY. Guests swim at their own risk and any children under 12 must be supervised. Any person under the influence of alcohol or drugs is prohibited from entering the pool or spa. Please do not use the hot tub or heated swimming pool if you are pregnant. Any tampering with pool equipment or settings will result in loss of damage deposit and any additional costs required getting the pool up to standard. Pets are NOT allowed in the pool area. Guest will leave pool area in clean condition, by throwing away trash and cleaning up after themselves. 

Common Area.  The corridor area outside of your condominium is considered a common area. Please respect other Guests need to move throughout this area and keep your personal belongings to a minimum. We encourage Guests to keep outdoor items on the balcony/patio instead of the corridor.  Please be respectful of other Guest and keep noise in the common area at a minimum. 

Lost or Stolen Property. Owner does not accept any responsibility for lost or stolen articles of Guests.

Excessive Cleaning.  Excessive cleaning fees will be deducted from the security deposit when the property is left in an extremely dirty condition. This includes the pool area. The decision to charge this fee is at the total discretion of the Owner.

No Firearms.  Firearms or weapons of any kind including paint ball guns, pellet guns, BB guns, pistols, shotguns or rifles are strictly prohibited.

Illegal Activities.  Any Guests engaging in or arrested for any illegal activity will be subject to immediate eviction without benefit of any refund of rental fees or deposits.

Noise Violations. Guest will not interfere with the peaceful enjoyment of the neighbors. The Guest understands that domestic disturbances not only infringe on the neighbors' peaceful enjoyment of the property, but are also in default of the Rental Agreement. Any noise complaints that result in the police coming to the facility will result in loss of deposit, all rental fees, and immediate eviction from the premises.  

No Fireworks.  No fireworks are permitted in or around the rental property.
