Reglas de la casa

Maximum Occupancy: The maximum number of persons (persons includes adults and children) in the Rental Party is normally limited to 14, unless otherwise agreed to herein by Homeowners. Parties of more than 25 people must be approved by homeowner.

Assignment. Guest shall not assign this Agreement or sublet the Property in whole or part without written permission of Homeowner.

Term of the Lease. The lease begins at 3:00 p.m. on the “Check-in Date”) and ends at 3:00 p.m. on the “Checkout Date”. Early check-in times can be requested but will not be guaranteed. Departures after 3:00 p.m. on the Checkout Date will be charged an additional half of the daily rental rate. In addition, failure to depart before 7:00 p.m. on Checkout Date will result in forfeiture of entire Security Deposit. Refunds will not be made for late arrival or early departure.

Rental Rules: Guest agrees that Guest will abide by the Rental Rules (attached) at all times while at the property and shall cause all members of the Rental Party and anyone else Guest permits on the Property to abide by those Rules at all times while at the property.

Amenities and Supplies: The Property is furnished, and rental includes the respectful use of the amenities on the property, and the provided items such as linens, towels, paper goods, etc. The Rental Party is welcome to use any of the ingredients in the pantry during the rental period for meals, and are also welcome to the beverages in the house. Adults in the Rental Party take responsibility for minors’ access to alcohol while on the Property. (Maryland State minimum drinking age is 21.)

Duties of Homeowners: Homeowner agrees to provide the Property to Guest in a fit and habitable condition. If, at the time of occupancy, Homeowner cannot provide the Property in a fit and habitable condition or reasonably cure same in such condition, then Homeowner shall refund to Guest all payments made by Guest.

In the case wherein the Property sustains a failure of a system or amenity during the rental period (including but not limited to water, sewer, heating, electrical, mechanical, ventilating, structural systems, pool, entertainment equipment, Internet or Internet access or other facilities or major appliances), Homeowner shall promptly repair in a reasonable manner and time such system or amenity upon receipt of notification from Guest that repairs are needed. Homeowner shall not be liable to Guest for damages and no refunds will be given for such temporary failure, provided the Homeowner repairs in a reasonable time and manner.

Access/Right of Entry: Guest shall allow Homeowner access to the Property during reasonable hours to inspect the Property, and to make repairs, alterations or improvements thereto as Homeowner may deem appropriate. Homeowner shall exercise this right of access in a reasonable manner.

Rental Rate and Fees
Half payment of all charges is due upon booking and signing of Agreement; please refer to the emailed quote for detailed description of all fees and rates. Full payment balance is due seven days before Check-in Date.

Upon written request to Homeowner, Guest will be provided with an accounting of funds relating to this Agreement. In the event of a rental overpayment, Homeowner will send Guest a check for the overage amount together with a letter requesting that Guest promptly cash the check. In the event, however, that Guest does not cash the check within 90 days, Guest agrees to forfeit the funds.

Taxes - We are required to collect 6% Maryland sales tax on the nightly rental price. That will be deducted from the security deposit before it is returned.

Refundable Secuity Deposit – Homeowners have a written and photographic inventory list of the house and property before the rental period. Guest is liable for theft of or any damages to the Property and to the furnishings, equipment, and/or household items therein which occurred during the rental period, excluding normal wear and tear. Guest agrees to report to Homeowner any damages during the rental period before departure.

Any refund of Refundable Damage Deposit to Guest shall occur within seven days of the Checkout Date. Homeowners have the right to retain all or part of the Refundable Damage Deposit, at their discretion, based on the provisions below. If any provision below is not met, an amount up to and including the entire Refundable Damage Deposit may be deducted from the refund. Total refund of Refundable Damage Deposit (excluding taxes) will be made if all provisions below are met:
a. No damage is done to the Property or its contents, beyond normal wear and tear.
b. No charges are incurred due to contraband or pets.
c. All debris and trash are placed in trash/recycling containers and soiled dishes are placed in the dishwasher.
d. All keys are left in the Property and Property is left locked.
e. All charges accrued during the stay are paid prior to departure.
f. No items are missing from the Property.
g. The house is kept in satisfactorily clean and sanitary condition during the rental period.
h. The Rental Party does not use the Property or allow the Property to be used for any illegal, unlawful or business purposes.
i. The Rental Party has not breached any local or community bylaws or rules and regulations, and does not cause any loud conversations, music, television or other irritating noise to disturb peaceful enjoyment of any other residents of the neighborhood at any time.
j. No early check-in or late check-out occurs.

Cancellation Policy: If Guest wishes to cancel his/her reservation, payments received by Homeowner will be refunded as follows:
• 100% if cancelled at least 14 days prior to the Check-in Date
• 100% if cancelled less than 14 days prior to the Check-in Date and the Property is re-rented on the terms set forth herein
• 100% less $1,000 if cancelled less than 14 days prior to the Check-in Date and the Property is not re-rented on the terms set forth herein

Insurance: Homeowner encourages Guest to purchase traveler insurance.

Indemnification and Hold Harmless. By accepting this reservation, it is agreed that the Guest, Rental Party, and others whom they invite to the Property are expressly assuming the risk of any harm arising from their use of the Property. Guest and Rental Party agree to indemnify and hold harmless the Homeowner for any liabilities, illness, injury, accidents, death, theft, damage, cost or expense whatsoever (including but not limited to attorneys’ fees) arising from or related to any claim or litigation which may arise out of or in connection with Guest’s and Rental Party’s use and occupancy of the Property, including but not limited to any claim or liability for personal injury, damage or theft of property which is caused, made, incurred or sustained by Rental Party as a result of any cause, unless caused by the grossly negligent or willful act of the Homeowner.

Acts of God/Construction Noise. Homeowner shall not be liable for events beyond their control which may interfere with Guest’s scheduled occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, terrorism, war, inclement weather such as storms, and construction noise from nearby sites. No rebate or refund will be offered in these circumstances.

Possessions of Guest or Rental Party: Homeowner is not responsible for any personal items or valuables of the Rental Party left on the Property; however, if something is left behind and Guest calls, Homeowner will exercise reasonable diligence to find and return any left items to the owner, at the Rental Party’s expense (postage or shipping costs).

Special Events: The use of the Property is restricted to use by the Rental Party listed above, unless both parties agree in writing to occupancy for a special event. Guests hosting special events such as weddings or large parties must be cleared with the Homeowner at the time of booking. Guests hosting a special event without Homeowner’s prior consent or knowledge is a material breach of this Agreement.

Use of the Property by fraternities, sororities or unrelated Groups under 22 years of age is strictly prohibited and Guest agrees that, in the event Homeowner discovers same, that any and all funds collected (including Refundable Damage Deposit) will be considered liquidated damages to cover losses, expenses and damages of the Homeowner for Guest taking the Property off the market.

Respecting Neighbors and Community: The Homeowners are committed to being good neighbors, and ask that Guest and Rental Party be considerate of those who live nearby. Unfortunately, from time to time some guests disturb the neighbors, by creating excessive noise, smoke, or other nuisances. Homeowners expressly reserve the right to terminate, at any time, Rental Party’s occupancy of the Property, and to evict the Rental Party from the Property, in the event that complaints are lodged which indicate that any members of the Rental Party are disturbing the neighbors. In that event, Guest will also forfeit all monies previously paid to Homeowners.

Expedited Eviction. A material breach of this Agreement by Guest or Rental Party, which, in the sole determination of the Homeowner, results in damage to the Property, personal injury to Guest or others, a breach of the peace, a nuisance to others, or a violation of law or local code, shall be grounds for termination of the rental. No refunds for early departure or evictions.

Pets. No pets shall be allowed on the Property. Breach of this provision shall be considered material, and shall result in the termination of Rental Party’s tenancy. The home on the Property is not guaranteed to be hypoallergenic.

Housekeeping – Daily maid service is not included in the rental rate. Additional housekeeping is available at additional cost upon request.

Guest’s signature on this agreement and payment of money in which to secure a reservation and/or taking possession of the rental property is evidence of Guest’s acceptance of the agreement, and that Guest intends to use the property for a vacation rental.

This Short-Term Rental Agreement, together with the Rental Rules referenced herein and attached hereto, constitutes the entire agreement between the parties relating to the subject matter hereof, and supersedes all prior written oral negotiations, representations, or agreements. No modification of this Agreement shall be binding on either party unless it is in writing signed by both parties. Each section, subsection or paragraph of this Agreement shall be deemed severable and if for any reason any portion of this Agreement is unenforceable, invalid or contrary to any existing or future law, such unenforceability or invalidity shall not affect the applicability or validity of any other portion of this Agreement.

RENTAL RULES

We as homeowners clean and do an inventory (written and photographic) before every rental. If you find, upon arrival, that something may be wrong (such as damages) that you could be charged for, please contact us immediately so that the defect can be noted when considering the Damage Deposit.

Respect: Please remember this is our home. We have made a concerted effort to make your stay enjoyable. Please respect our home and property like you would your own.

The refrigerator and stove are of special importance to the homeowners. Any scratches incurred during the rental period will result in replacement costs being deducted from the Damage Deposit.

Keep wet towels and bathing suits off all wood floors and countertops.

Close windows on the street side and beach side of the home if there is a chance of rain. The breeze drives the rain through those windows and damages the wood floors. In very windy conditions, please close all windows if there is a chance of rain.

We baby our wood countertops. Avoid sitting any metal containers (including pots, pans, and aluminum cans) on the wood counters, and wipe up any standing water or food preparation liquids immediately. Metals cans, vegetable and berry juices, and wine in particular are quick to stain the counters.

Please do not move any furniture around, which can result in extra time for us to get our home ready for the next guests (or ourselves); and could cause costs to be deducted from the Damage Deposit.

Smoking is NOT allowed inside the house, but outside only; please dispose of butts safely and not in the yard or on the beach.

Pets are NOT allowed.

HVAC: Our home contains two Heating, Ventilating and Air Conditioning (HVAC) zones; each zone has its own control unit. The control unit for the downstairs zone is located in the overlook room; the control unit for the upstairs zone is located in the Master bedroom. Please shut off both control units when enjoying open doors and windows so as not to waste electricity or overburden our HVAC units.

Amenities and Supplies: Our home is furnished, and rental includes the respectful use of the amenities on the property, and the provided items such as linens, towels, paper goods, etc. You are welcome to use any of the ingredients in the pantry during the rental period for meal preparation, and also welcome to the beverages in the basement refridgerator. Adults in the Rental Party take responsibility for minors’ access to alcohol while on the Property.

Parking: There is limited on-street parking; our property has space to park up to eight cars in the driveway/yard, in two rows of four cars each, next to the road. You should not park vehicles at the nearby beach parking lot, because vehicles without local stickers will be towed. Applicable fines/towing fees are the sole responsibility of the vehicle owner. You have easy access to the beach on foot through the back yard.

Garbage: Place any garbage in the proper trash can or recycling bin, located on the lake side of the house.

Fireplace: The fireplace has a soapstone woodstove. Please do not put anything other than fire starter sticks, newspaper, and untreated wood in the fireplace. Directions for operating the woodstove are provided. Please follow them. The surface of the stove gets extremely hot when the woodstove is burning. Adults should caution children especially of this danger. Renters take responsibility of injury as a result of operating the woodstove.

Water: The house on the Property is on a private well. As such, you should be conscious that wells do not produce unlimited water, and exercise reasonable restraint in the length of showers. The mineral content in the well’s water is high, so the water conditioning system is meant to rectify that. During a drought, the well water may have a mild odor.

Plumbing: The toilets will clog up if improper material is flushed. Do not flush anything other than toilet paper. No feminine products nor wipes should be flushed at any time. If it is found that feminine products or wipes have been flushed and clog the plumbing system, you could be charged repair costs.

Pool: Use at your own risk. We are not to be held responsible for accidents in any areas. It is your responsibility for the safety of yourself, your children, and guests.

Please keep the pool gate closed and locked at all times when an adult is not present and keeping watch at poolside.

The swimming pool is a saltwater pool that uses a chlorine generator to create chlorine from the salt in the water in order to sanitize the pool. However, a small amount of chemicals is occasionally added to the water to keep pH, minerals, and metals at proper levels to ensure the safe and long-lasting use of the pool. This may cause slight skin irritation to some individuals, although we have not found this to occur in the past.

To ensure proper filtration and cleanliness of the pool, please empty the skimmer basket (located in the covered hole in the pool sidewalk opposite the pool deck) once every 24 hours; and then replace the basket and lid to the hole.

The pool pump and filter are required to operate for 7 hours each day, and will automatically run between the hours of 9 a.m. to 4 p.m. We chose those hours to avoid disturbing guests and neighbors who enjoy sleeping with the windows open.

Please turn off the in-ground pool light when not in use; this extra delight was expensive!

Housekeeping: Cleaning takes place immediately after you leave. While you are there, you are responsible for keeping the home reasonably clean. Please take care of it, as this is our home. There is a supply of normal/general home cleaning products. If you would like to have cleaning done during your visit, we will schedule additional cleaning for additional cleaning charges. Overly stained linens beyond normal use will result in a decrease in the Damage Deposit refunded.

Modesty: We are in a quiet, family-oriented neighborhood. Out of respect to our neighbors and residents in the community, especially children, we request that you exercise modesty with regard to bedrooms and using the pool. Please refrain from swimming naked in the pool. When the sun is streaming into bedrooms, and at night when the lights are on inside the house, be aware that you are visible to people outside. We request that the draperies be drawn during those times, as residents often take walks at night.

Use of the beach at night. The community beach and fishing/crabbing pier are closed after dusk. The police and community association officers are called by residents around the beach and lake if they see people there after dark. If guests are caught violating these community rules, the rental party will be evicted from the property and deposit monies will be forfeited.

Noise: You should not create excessive noise at a level that disturbs neighbors or the community; Code-enforced neighborhood quiet hours are from 10:00 p.m. – 8:00 a.m.

Fireworks of any nature are strictly prohibited.

Departure: Please do the following before departure:
• Take or throw away any food items you brought into the house
• Put dirty dishes in the dishwasher, and hand wash any oversized dishes that don’t fit
• Empty the trash from all rooms and take to trash cans/recycling bin.
• Leave any house keys on the kitchen counter, and lock all doors on your way out.
