SHORT TERM RESIDENTIAL RENTAL AGREEMENT
This Short Term Rental Agreement (the “Agreement”) is made by and between Prashant Group, LLC (“Homeowner”), and the booking site user (“Guest”). This agreement shall be effective upon completion of an accepted and confirmed reservation.
The parties hereby agree as follows:
The property address as provided in the reservation acceptance confirmation.
Guest is authorized to use the property for dwelling, lodging, and sleeping purposes only. The city and county may assess fines to individuals conducting events in residential areas. Tenant shall comply with all health and sanitary laws, ordinances, rules, and orders of appropriate governmental authorities with respect to the premises. Guest shall have use of all bedrooms, bathrooms, interior common areas, exterior common areas, and the attached garage. Tenant understands and acknowledges that they are not permitted to access the attic crawl space, any locked storage areas, the roof, under the home, or any other area of the property that is not considered living space. Tenant shall not commit waste, cause excessive noise, create a nuisance or disturb others.
Hosting an event will result in immediate cancellation of your booking and no refunds will be given.

Occupants: Guest is permitted to allow up to the number of individual occupants listed in the reservation confirmation.
Maximum Occupancy: The maximum number of guests is limited to 10 person. Exceeding this occupancy limit is grounds for immediate cancellation of this agreement with no refunds. This is NOT a Party House and cannot be used for any events.
Term of the Lease: The lease begins at 3 pm on the “Check-in Date” and ends at 10 am on the “Check-out Date”. The Homeowner grants the guest a limited term tenancy only for the period between the check-in date and check-out date. Early check-in and late check-out must be approved by a property manager.
Check-in/Check-out Times: Check-in time begins at 3pm on the "Check-in Date" and check- out time is no later than 01am on "Check-out Date". Early check-in and late check-out must be approved by a property manager.
Minimum Stay: This property requires a 30 night minimum stay. Rentals of less than 30 nights will not be accepted.
Rental Rules: Guest and anyone else Guest permits on the property must abide by the RENTAL RULES at all times while on the property.
Amplified music and outdoor noise: Amplified music is not permitted outside. Enjoy the backyard as much and as often as you like, however after 10 PM, all guests must use "inside" voices, as to not disturb neighbors.
Smoking: Smoking, of any type, is NEVER allowed inside the house. If you smoke outside, you must dispose of butts and ashes appropriately. If you smoke in the house, you will forfeit your security deposit.
Glass: For everyone’s safety, no glass in the back yard. There are multiple acrylic options available in the house. No one wants to ruin a vacation by stepping on someone else’s broken beer bottle or wine glass. It’s a desert out there: Enjoy all the water features of the property, but please don’t be wasteful.
Housekeeping: There is NO housekeeping offered during your stay unless your stay is longer than 14 consecutive nights. Stays longer than 14 consecutive nights require one (1) additional cleaning per fourteen (14) day period (charges apply).
Trash: Please bag all of your trash and leave it in the garage and it will be taken away when you leave or feel free to put it to the curb in the provided large exterior trash can, the night before your designated trash days (displayed on the "House Rules" board).
Tenant shall make no alterations/changes to the the premises that would permanently affect the property. If anything is found missing or broken during the checkout inspection, Guest will be billed based on the damage done.
Pet Policy: Pets are not allowed on the property. Homeowner reserves the right to cancel a reservation and charge a $500 cleaning fee if a guest is found to have a pet on the property.
Damage Deposit and Responsible Party
Guest shall be responsible for all damages to the property which occur while the property is under the guest’s control (between check-in date/time and check-out date/time). Homeowner/Property Manager reserves the right to seek additional relief by all legal means should tenant caused damages exceeds the limit. Guest agrees a claim may be made against any security deposit / damage deposit held by your booking site within 14 calendar days of check-out date.
Guest acknowledges there shall be no security deposit held by Property Manager or Homeowner. Guest acknowledges the Property Manager / Homeowner will seek a claim for the following: Damage or theft to property, equipment, furnishings, linens, or other household items.
Damage to the personal property of the Homeowner or Property Manager
Indoor smoking, excessive dirt, excessive trash, or other mess requiring additional cleaning and will be billed at USD $50 per hour.
The above list is not all inclusive and is only for representational purposes of the type of claims. Homeowner and Property Manager do not waive any rights to seek relief for damages.
Please verify all doors and windows are secure before exiting the property.
If the premises appear dirty or damaged upon Check-in, Guest shall inform Property Manager immediately.
Cancellation Policy: If a guest wishes to cancel his/her reservation, funds will be refunded per the cancellation policy on your booking site.
Personal Insurance: HOMEOWNER/Property Manager shall not be liable for any damage or injury to GUEST or any other person, to any property occurring on the Premises or any part thereof. Guest agrees to indemnify, defend and hold OWNER/Property Manager harmless from any claims for damages. GUEST understands that OWNER’s insurance does not cover GUEST’s personal property. Homeowner / Property Manager is not, cannot and will not be responsible for personal property of the Guest while at the property. Guest is responsible for their personal property at all times.
Payments: Payments shall be made via your booking site at the time of booking. A booking will not be confirmed without successful payment in accordance with the payment procedures of your booking site. Cancellation penalties may apply.
Processing Fees: Guest is responsible for the payment of any processing or transaction fees charged to guest by your booking site. Property Manager and Homeowner have no control over your booking site's fees.
If guest remains in possession of property beyond the “Check-out date,” Homeowner will initiate eviction proceedings. Evictions are public record filed with the local court. Guest shall be charged for services of legal notices and all related fees according to actual costs incurred.
Homeowner / Property Managers shall be provided access to the property with 24 hour notice to guest. Notice may be verbal, via email, or posting at the property. In the event of an emergency, Property Manager is authorized to immediately access the property.
The Property Manager may be reached via phone, text, or email.
A representative of the Property Manager is available 24 hours per day at via voice or email. Guests may also communicate with the Property Manager via your booking sites message system. Details about Property Manager are available in the House Manual attached to the side of the refrigerator.
Guest and any member of guest’s party shall not engage in any illegal activity, including but not limited to, illegal drug related activity, manufacturing, use, sale or distribution of any kind, gang related activity or acts of violence on the property. Any illegal use of firearms is prohibited.
In the event of any court action, the prevailing party shall be entitled to be awarded against the losing party all costs and expenses incurred thereby, including, but not limited to, reasonable attorney’s fees and costs.
All occupant vehicles shall be parked on site, and shall not be parked in the adjacent public right-of-way. Street parking can be used as permitted by the local laws. No commercial vehicles shall be permitted on the short term residential unit property or parked in the adjacent public right-of-way, except where otherwise permitted in commercial zoning districts.
Homeowner is committed to providing an environment free from harassment, violence, intimidation, threats and discrimination. Homeowner complies with all applicable Federal and State regulations relating to Fair Housing.
Homeowner does not permit discrimination or harassment of agents, vendors, contractors, associates, or any other representative of the Homeowner, Property Managers, occupant or their family, guests, or licensees of any kind.
