- Rental Agreement Terms and Conditions 1. This Rental Agreement is made between William Bartel (Homeowner) & Guest who completes the online booking of this rental property. By completing the booking transaction the Guest agrees to abide by the following Terms and Conditions of this Rental Agreement while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property without exception. 2. Property: The property is located at: 40872 Village Pass Lane, Shaver Lake, CA 93664 3. Maximum Occupancy: The maximum number of guests is limited to 16 persons. If guest allows more people to stay the night in the property than the stated maximum occupancy, guest agrees to pay a $250 over-occupancy fee, and hereby authorizes this fee to be deducted from the security deposit. 4. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner. 5. Cancellation Policy: If you cancel less than 60 days before your arrival date the full rent amount is forfeited. Rent will not be returned or prorated if you arrive late or leave earlier than your scheduled departure. The Homeowner has the right to cancel any reservation if the property is no longer available for rent or in their view it is unsafe to rent. Cancellation due to weather conditions, lack of snow or lake level is not acceptable under our cancellation policy. 6. Full Payment: Full Payment is due 60 days in advance of arrival. 7. Non-Refundable Cleaning & Linen Fee: $325 8. Reservation Deposit: If greater than 60 days before arrival, a Reservation Deposit of $150 will be charged to reserve the property. This Deposit is non-refundable if reservation is cancelled. 60 days prior to your stay when full payment is required, the $150 Reservation Deposit will be credited toward your full payment. 9. Refundable Security Deposit: When full payment is required, a Refundable Security Deposit of $250 will be charged and shall be refunded within 14 days of the Checkout Date provided no deductions are made due to: A.) Damage to the property or furnishings. B.) Dirt or other mess requiring excessive cleaning. C.) Violation of Rental Agreement Terms and Conditions. D.) Any other cost incurred by Homeowner due to Guest’s stay. If the premises appear dirty or damaged upon Check-In, Guest shall inform Homeowner immediately. 10. Check-In/Check-Out: Check-in time is 4:00 PM. Check-out time is 11:00 AM. Late Check- outs are not allowed without advance permission from Homeowner, and if granted may be subject to additional rent being charged. One additional night’s rent will be charged automatically for unapproved late Check-outs. 11. Insurance: We encourage all renters to purchase traveler insurance. 12. Smoking: Smoking is NOT permitted anywhere inside the premises of the rental property. Guest authorizes a $250 smoking fee being deducted from security deposit immediately upon discovery of smoking in the property, PLUS entire cost to remedy smoke odor and/or other damage. 13. Lawful Occupation: Occupants, guest and invitees shall not use the premises for any unlawful purpose including but not limited to, using, manufacturing, selling, providing, storing or transporting illicit drug or other contraband, or violate any Federal, State or local law or ordinance, including, but not limited to, the use of alcohol by minors or commit waste or a nuisance upon the rented premises. 14. Guest: People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest. 15. This unit is privately owned; the Homeowners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 16. Indemnification: Occupants acknowledge that the Homeowner is not liable for any injury, loss or damages caused to the Occupants, their guests or invitees or any of their personal property that is, or may be caused by, any accident, event, fire, theft or other casualty or cause during the rental period. 17. Keep the property and all furnishings in good order 18. Only use appliances for their intended uses 19. Pets: Pets are NOT allowed under any circumstances. If evidence of a pet is found on/in our rental property, guest authorizes a $250 fine being deducted from security deposit immediately. Guest is responsible for and will pay all costs necessary, as determined by the Homeowner, to remove scent, hair and all other pet related issues from property. You authorize the Homeowner to charge all expenses for repairs caused by your pet to your credit card without further authorization. 20. Noise: Please be sensitive and respectful of the neighbors around you. They could be full- time residents on a different work/sleep schedule than you who are on vacation. Quiet time is 10:00 pm to 8:00 am, during which music, barbecuing and other outdoor activities must end and guests move inside. You are required to follow all noise ordinances. Failure to do so could result in an early departure without refund. If the Homeowner is called to handle a situation at your rental property due to noise or misconduct, you agree that your security deposit of $250 will be forfeited. 21. Emergency Calls: Guest agrees that guest shall pay Homeowner/management time required responding to an after business hours, non-emergency issue or if the owner/management is called out for a guest-caused issue of any kind. Rate charged to guest is $85.00 per hour, one hour minimum. Charge will be deducted from security deposit. Homeowner solely determines whether issue was emergency, non-emergency or guest-caused. 22. Parking: Parking is limited to 3 vehicles. Two vehicles in the garage and one outside. Vehicles are to be parked in designated parking areas only. There is some overflow parking available but it cannot be guaranteed available. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. 23. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the units. 24. No Campfires: Campfires are NOT permitted on our property under any circumstance. Be advised that if evidence of a campfire is found, or we are notified, or you are witnessed having a campfire you authorize a $250 fine immediately being deducted from Security Deposit. 25. Telephones / Satellite: Telephone is for local and emergency use only. Satellite programming (i.e. “pay per view”) is available, but only when advance arrangements are made with the owner. Guest is responsible for ALL long distance calls and/or additional television programming appearing on the owner’s bill during their stay plus a $50 service fee (deducted from security deposit) if prior arrangements with Homeowner were not made. Be advised that Satellite TV might not be available when weather distorts the signal or if snow builds up on the satellite dish. Homeowner will not be held responsible for lack of Television service. 26. Linens/Paper Goods: Linen service is provided. Blankets and pillows are provided. You must bring all paper goods, bath & dish soap and any personal/specialty items. Guest is charged for linens that are missing or damaged. 27. Mishaps/Weather: Homeowner is not responsible for inconveniences due to the elements. In the event a problem occurs, we will do what we can to help you in a timely manner. Owner is not responsible for damage caused by appliances. No discounts or refunding of rent will be given for mishaps, weather, ski/boarding conditions at China Peak or lake conditions. Be advised that Satellite Television might not be available under certain weather conditions or if snow has built up on the Satellite Dish. During winter months, you must carry tire chains (per Cal Trans regulations), and it is advisable to carry a shovel and sand or salt in your car at all times. Parking is plowed in the winter. Road and driveway snow removal is done by independent vendors on their own schedule. Cancellation due to weather conditions, lack of snow or lake level is not acceptable under our cancellation policy. 28. Equipment/Appliances: Every effort is made to keep televisions, DVD players, coffee pots, washer, dryers, etc. in good working order; however, the Homeowner does not guarantee that they will work properly during your stay. If a particular appliance, utensil, etc., is important to you, we suggest you bring it with you. If the gas BBQ is found with evidence of charcoal use, the guest will be charged for cleanup or total BBQ replacement if damaged. We don’t guarantee BBQ usage in winter. 29. Lost or Missing Items: Homeowner is not responsible for the return of, or the value of, any items of personal property that are not removed from the rented premises at the termination of the rental period by the Occupants, their guest or invitees. 30. Safety: Wear proper equipment and keep snow and ice clear of walkways and driveways. Homeowner is not responsible for personal injury or damage to your property while occupying our property. Guest agrees to hold Homeowner harmless and free of liability for injuries or damage that may occur during guest’s stay. 31. Legal Disputes: If any legal action or proceeding arising with respect to the rental agreement is brought by either party, the prevailing party shall be entitled to receive from the other party, in addition to any other relief that may be granted, the reasonable fees, costs, and expenses incurred in the action or proceeding by the prevailing party. It is agreed that in the event of any legal dispute, the laws of the State of California shall apply. 32. Agreement To Terms and Conditions: Guest is at least 25 years of age or older and occupying the property during rental terms. If Homeowner finds that Guest has made a false representation of occupants, or the sole occupants at the premises are under the age of 25, or that there are any unsupervised minors at the premises, Guest is subject to immediate termination of tenancy with no refund of rental monies. Prices, terms and amenities are subject to change without notification at Homeowner’s discretion.
