GENERAL TERMS AND CONDITIONS:
The premises is licensed to accommodate a maximum of 16 persons (Guests), and this limit should not be exceeded at any time during the stay. If more than 16 people are on/in the property at any time, eviction and additional fines will occur of $50 per person per day. The maximum of 16 guests are strictly enforced and must be only the people on the submitted guest list.
You will be required to provide a list of those who are in your party, and only they are authorized to use the property. If there are any changes to the persons booked to occupy the home, you must notify the Booking Agent or Prestige Florida Villas for insurance reasons. This must be received before you receive your check-in information. A list of make/model/license plate numbers of all vehicles that will be on the property must also be provided. Any and all unauthorized person(s) entering the home during your stay not included on this submitted list will result in eviction and additional charges will occur.
All Guest(s) must observe and obey all terms and conditions contained in the Lease Agreement. If the Guest(s) violate any part of this agreement then they are in default of the Rental Agreement. In the event of a default, the owner/agent or property manager (Prestige Florida Villas) may initiate legal proceedings in accordance with Florida and local regulations to evict or have the Guest(s) removed from the premises as well as seek judgment against the Tenant for any monies owed to the owner/agent as result of the Guest(s)'s default. Default of this agreement is an automatic forfeit of any and all monies and rental funds made to owner/agent.
You are not allowed any inflatable mattresses without the approval of the home owner and/or Prestige Florida Villas in advance and in writing. Adults are not allowed to sleep or be in the youth beds. If anyone other than the people listed on your guest list are found to be staying at the home, it breaks the home’s polices and you will incur fines up to but not limited to $50 per day. No RVs or campers are allowed. Cars have to be listed on contract, make, color, and model. If it is a rental vehicle, you must provide the name of the rental car company and the full name of the person who rented the vehicle. The maximum number of guests per residence is limited to the actual sleeping capacity for that rental residence. 2 people per king bed, 2 people per queen bed, 2 people per full bed, 1 person per twin bed. The renter must closely and personally supervise all occupants of a property under the age of 25 years. Any reservation made under false pretenses will be subject to loss of rent and eviction. You are responsible so please watch after children. Do not let children mark on walls, furniture, books or any other items. Do not allow children to place stickers on any items in home including, but not limited to, walls, mirrors, furniture or bedding.
For the protection of all guests within Emerald Island Resort, this community is a guarded and video monitored community. Guest(s) will have to sign in with documentation before being allowed to enter the community. Emerald Island monitors and has limits on how many vehicles are allowed at an address. The owner/agent has no control over this. The exterior entrances and exists are video monitored.
Quiet Hours :
11:00 PM - 8:00 AM - Monitored and Enforced. Emerald Island is a special neighborhood with a family environment. Osceola County has a Noise Ordinance (#94-14) that is enforceable 24 hours a day. Please respect the desire of our full time residents and other rental home guests in honoring quiet hours and being courteous all times of day.
Check-in time is 4:00 pm and checkout time is 10:00 am. Many bookings are back to back and our team of cleaners requires this amount of time between renters to do a thorough job. Early check-in or late checkout may be possible if it is not a turn over day, but this requires prior approval and possibly an additional fee. Please contact Prestige Florida Villas as each situation is individual. AFTER 10:00 am ON DAY OF CHECKOUT, A FEE OF $25 WILL BE CHARGED FOR EVERY QUARTER HOUR (15 minutes) YOU ARE LATE LEAVING. For example, if you leave between 10:00-10:15, $25 will be charged. Because this is a private home with a private lease, there can be no credit given in case of early departure, and there will be no sub-letting or assignment by Tenant.
This home does not have a physical key and all exterior doors require some form of electronic interaction to pass through them. Windows and doors must be secured at all times. Someone over the age of 18 must be in the home if house is unsecured. A breach of this Policy shall result in fines.
All utilities, electricity, water, waste disposal, telephone, internet, cable, management fees, maintenance contracts, community charges, HOA fees, etc. are included in the rental fees and the Tenant shall not be required to pay additional monies on account. EXCEPTION: International phone charges, as well as excessive use of utilities resulting in a cost rising by 100% or more. This is to prevent wasteful usage in the home (i.e.- leaving a hose running for an extended period of time).
Do Not leave the front door or lanai doors open at any time. The front door has a mechanical lock that will lock behind you automatically each time it is closed. You will have to enter the assigned door code given to you to get back inside. If you leave the door open you will increase utility costs as the systems will continue to run as you will be releasing the cooled or heated air. If the door is found to be left open at any time there may be an additional fee charged. Leaving the door open also allows Florida wildlife to get into the home.
You are required to be responsible for all guests during your stay. If damages do occur, the costs to repair will be charged to you to repair or clean any item that exceeds normal wear and tear or cleaning. If you do not follow check-out procedure you will be charged $50 additional for each item not completed. Any items removed from the home without permission will also be regarded as damage to the home and be charged accordingly.
Guests shall not move, remove, or rearrange furniture or decor during their stay. If furniture is moved/removed from its original position and not returned to its original position in its original condition in the home before check out, it will be regarded as damaged and full replacement costs will be charged to the guest. If decor is moved, it is not convent for property managers to find/retrieve/reposition decor. Costs will be charged to find and replace items to their correct place. Decor pillows are not to be used for sleeping. No food or drinks are allowed in bedrooms or carpeted rooms at any time. As well, no property will be removed from the premises. This includes, but is not limited to, furniture, bath towels, pool towels and any kitchenware (plates, silverware, pots, pans, bakeware, etc.). Any property removed from the premises, EVEN IF IT IS BROUGHT BACK ONTO THE PREMISES, will be considered damaged and full replacement costs will be charged to the Guests if such removal occurs.
If you wish to use Emerald Island community pool, towels are provided in the clubhouse. Any towels that leave the premises are considered damaged regardless of if they are brought back onto the premises and the full replacement cost will be charged. Pool towels are for the enjoyment of the Guests in the home/pool area only. Please do not swap our pool towels for yours. We will charge you if any of the pool towels are missing or swapped.
BATHING TOWELS ARE ONLY TO BE USED FOR BATHING. DO NOT USE BATH TOWELS IN THE PLACE OF POOL TOWELS.
All Guest(s) must observe and obey all terms and conditions contained in the Rental Agreement. If the Guest(s) move or remove property, the Guest(s) is then in default of the Rental Agreement. In the event of a default, the owner/agent or property manager (Prestige Florida Villas) may initiate legal proceedings in accordance with Florida and local regulations to evict or have the Guest(s) removed from premises as well as seek judgment against the Tenant for any monies owed to the owner/agent as result of the Guest(s)'s default. Default of this agreement is an automatic forfeit and charges will be incurred.
Our home is privately owned and decorated to our personal taste. Please remember that this is our personal home and treat it with care during your stay. Do not move furniture. You may view photos of our home on our website. Photographs are meant to give a general feel for the home; specific furnishings and décor items in the home may change from time to time and may vary from photographs.
For your protection we recommend that you thoroughly inspect the home for damage when you first arrive. If anything appears to be broken, damaged, or missing, please contact the property management company, Prestige Florida Villas, to inform them immediately.
Should damage occur during your stay, please inform the property management company of this damage the day it happens. The owner or property manager has the authority to inspect the property at any time during your stay.
No parties can be planned without the authorization from the home owner and/or Prestige Florida Villas. Catered food, rented/owned items including but not limited to tables, furniture, appliances, grills, fryers or amplified music needs to be approved and arranged with the owner or Prestige Florida Villas prior to visit. Bringing these items on site without written permission will result in immediate removal and additional charges of $500 or more.
The thermostats in the home are programmed so that you will be able to adjust the cooling temperature in the home down to 75 degrees and up to 80 degrees F and heating air temperature in the home 65 to 75 degrees. Any attempts to adjust the temperature outside this temperature range will be futile and may cause damage to the thermostats. You will be charged for repair and/or replacement of either thermostat if you damage them. Do not manipulate heating and cooling equipment inside or outside. If you are having trouble with heating and cooling, please contact the management team at Prestige Florida Villas.
This is a pet free home, no exceptions. Any pet/animal brought on premises or into the home will result in eviction and additional charges.
This is a NON-SMOKING PROPERTY. Smoking is NOT allowed on the entire property. Anyone choosing to smoke must smoke at the sidewalk or beyond. Smoking is NOT allowed outside the home and not near homes windows or doors. You must pick up and dispose of cooled cigarette or cigar debris left at the sidewalk or beyond.Guests must follow additional terms, conditions and rules hereby incorporated into this No-Smoking/Tobacco Policy. A breach of this Policy shall result in additional charges.
Purpose of No-Smoking Policy. The parties desire to mitigate (i) the irritation and known health effects of secondhand smoke; (ii) the increased maintenance, cleaning, and redecorating costs from smoking; (iii) the increased risk of fire from smoking; and (iv) the higher costs of fire insurance for a non-smoke-free property.
Definition of Smoking: The term "smoking" means inhaling, exhaling, breathing, or carrying any lighted cigar, cigarette, electronic cigarette or other tobacco product or similar lighted product in any manner or in any form. Smoke-Free Complex. Guest(s) agrees and acknowledges that the entire premises to be occupied by Guest(s) and/or Occupants have been designated as a smoke-free living environment. Guest(s) and the Occupants of the premises shall not smoke or use smokeless tobacco anywhere on the property rented by Guest(s). This non-smoking environment extends to any outdoor area including the pool area, front porch, yard and the driveway area. All smoking/tobacco use must be done at the curb or beyond.
All Guest(s) must observe and obey all terms and conditions contained in the Rental Agreement. If the Guest(s) violate any part of this No-Smoking/Tobacco Policy, the Guest(s) is then in default of the Rental Agreement. In the event of a default, the owner/agent or property manager (Prestige Florida Villas) may initiate legal proceedings in accordance with Florida and local regulations to evict or have the Guest(s) removed from premises as well as seek judgment against the Tenant for any monies owed to the owner/agent as result of the Guest(s)'s default. Default of this agreement is an automatic forfeit rental funds made to owner/agent and you will incur additional charges. Additionally, if Guest(s) should breach this No-Smoking/Tobacco Policy, Guest(s) shall reimburse Landlord for any and all expenses incurred to restore the unit to a smoke free condition in addition to forfeiting the remaining rent monies.
Because there are no lifeguards or other attendants, Tenants are solely responsible for the safety of themselves, family members and guests using the pool, and in so using or permitting to be used, specifically waive any and all liability claims. No Tenant shall permit any juvenile member of his family or guest to play in or around the pool without providing an attendant who is able to swim and can protect such juvenile in case of difficulty in the water.
Do not manipulate pool or spa equipment settings. Changing settings on pool equipment can cause a call-out charge. If you are having trouble with pool or spa equipment, please contact the management team at Prestige Florida Villas. Pool nets are provided to remove anything that is not supposed to be in the pool. In Florida, it is not uncommon to have worms or other wildlife find their way into the pool. If you should have dangerous wildlife get into the pool (e.g. snake), do not attempt to remove it yourself. Please call the management company, Prestige Florida Villas. Do not throw food, trash, or other debris into the pool as it can damage to the pool or its filters. If you enter the pool without a shower, dirt, oils, and creams can get trapped in the pool filters and clog them, causing the pool not to operate correctly. Please shower before pool use. Any extra cleaning or damage to the pool can incur a charge. Before departure pool enclosure deck must be free of debris/trash and food.
BBQ Gas/Charcoal Grill/Fryers:
f you rent the BBQ gas grill for an additional charge, LAW PROHIBITS USE OF THE GRILL INSIDE THE SCREENED POOL ENCLOSURE. DO NOT BRING THE GRILL INSIDE THE SCREENED POOL AREA OR INSIDE THE VILLA. The grill is a Tru-Infrared grill and must be cleaned with provided nylon grill brush to avoid damages. To clean, run grill for 15 minutes after food is removed, cool grill, and then use nylon brush to clean. We offer this grill at a fraction of the cost of renting one from another company during your stay. If you run out of propane it is up to you to fill it. We do not guarantee that propane will be on site at your arrival and you may need to go purchase propane for your stay. The grill must be cleaned per above instructions before your departure. The gas grill has a provided grill cover. You must keep grill covered when not in use. DO NOT put the grill cover on while the grill is hot or grill or cover is wet, as this is dangerous and will cause damage. You cannot hold the owners or Prestige Florida Villas responsible if you or your guests have any accidents with the gas grill. Propane is not allowed inside the home or screened pool enclosure at anytime. Propane must stay with the grill at the side of the house at all times.
No HAZARDOUS materials are allowed on the premises including but not limited to, CHARCOAL GRILLS, CHARCOAL, LIGHTER FLUIDS, MATCHES, FIREWORKS AND CANDLES. FRYERS of any kind are not allowed on the property at any time. This includes but is not limited to TURKEY FRYERS.
If the Tenant violates any part of this Gas/Charcoal Grill/Fryers or Hazardous Material Policy, the Tenant is then in default of the Rental Agreement. In the event of a default, the owner/agent or property manager (Prestige Florida Villas) may initiate legal proceedings in accordance with Florida and local regulations to evict or have the Tenant removed from the leased premises as well as seek judgment against the Tenant for any monies owed to the owner/agent as result of the Tenant's default. Default of this agreement is an automatic forfeit of any and all it rental funds made to owner/agent and incur additional charges.
The Tenant is expected to conduct himself as a guest with reasonable decorum; violent/rough activities are not permitted. DO NOT climb, jump or have violent/rough activities on the furniture. DO NOT bounce balls or play with other outside items, inside the home. NO sports equipment inside the home at any time. NO cleats or sport shoes should be worn inside or on the lanai at any time. NO wheeled sports items including, but not limited to, rollerblades, heelies, roller skates, skateboards or hoverboards on the property.
Spa, Deck, and Patio:
The Tenant hereby acknowledges that the property they have reserved includes a swimming pool, spa, and patio area. The undersigned is fully aware that the surrounding areas can be dangerous and slippery when wet, and that injury is likely to occur to anyone who is not careful. Tenants should observe and adhere to all rules and policies as posted at the property. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the pool, spa, and patio areas. No glassware is permitted in the pool area. Acrylic dinnerware and tumblers are available for dining on the patio.
Sliding patio doors are equipped with alarms per Florida Law. You must not tamper with or disable alarms.
The home is made ready for your arrival. Please leave the home in the same general condition as it was when you arrived. Our cleaning staff and property manager will arrive after your departure to thoroughly clean and inspect the home and it’s inventory. There is a STANDARD move-out cleaning fee added to or included in your rental cost. If the property is left in a condition that requires more than standard move-out cleaning, an extra fee will be incurred.
If you are applying or have applied sunscreen, lotions or creams, or are wet from swimming in the pool, DO NOT touch, sit or lie on bed coverings, blankets or any inside furniture as this is extremely hard to remove from these items. An extra fee will be charged to your credit card if these damages occur. Please towel dry off before you enter the home after swimming in the pool. Kitchen must be left clean and orderly, no dirty dishes, ovens, microwave ovens, small appliances or stoves.
Before departure, strip beds of their sheets & pillow cases and leave in front of the washer/dryer area. Start a load of towels before you leave so they are ready for the cleaning staff to place in dryer. You MUST use laundry soap/detergent for this load of laundry. All kitchenware/dishes must be cleaned and return to the appropriate cabinet/drawer before your departure. You must use dishwasher soap/detergent for the dishwasher and dishwashing soap/detergent for hand washing kitchen items. The floors should be broom clean.
Trash/garbage must be taken out to the roadside on the designated days during your stay. This information will be found in the guest handbook.
On departure, all trash/garbage must be bagged and left outside in trash container ready to dispose of. You must take all trash that does not fit in the trash container to the trash compactor located at the front of the resort. You may ask the clubhouse or security personal for help in locating the trash compactor. Garbage containers are provided at the side of the house. Do not leave filled garbage bags in the house. Excessive trash/garbage left inside or not within the trash container will incur separate charges (up to but not limited to $50 per bag of trash) which will be billed to your credit card on file. Trash that is taken to the trash compactor is not included in these charges. Recycling bins are also provided for your use during your stay.
You must dispose of all food, clothing tags, stickers or any other items you have brought into the home that is considered trash.
Kitchen items and decor in home are not toys. DO NOT play with items as if they are toys. DO NOT take kitchen items into pools or outdoors to play with. This will result in extra charges.
We want all guests to enjoy our theatre room. Please respect this room, as with all areas of the house. Do not leave children under the age of 18 unsupervised in this room. The equipment and furniture is expensive and costly to replace. Do not touch the projector at any time. Do not touch the theatre screen at any time. Do not go behind the curtains at any time. Do not unhook or reset any theatre equipment. Do not hook up or attach any of your own equipment at any time. Do not change settings on the equipment. Do not uncover or tamper with the garage door. Please sign out of any accounts that you have signed into. We have found almost all guest forget to do this and leave account open for others to purchase movies or games. We are not responsible if you leave accounts open or private information is obtained or your accounts are charged. Please use reclining seats in the manner they are made for. Do not use this room as a bedroom. Leave all remotes to game console, TV, projector, master remote and receiver on table in theatre room. Leave the Heating and Air remote attached to the wall.
Game Consoles, Televisions, DVD players:
In certain rooms in the home there are game consoles, remotes, games, televisions and DVD players. These devices are not to be moved or unhooked at anytime and are to stay in the rooms you find them. DO NOT tamper with settings or you may incur fees to have items re-synced or returned to initial state. These items are inventoried and are accounted for before your arrival and after your departure.
You will find remote controls for TV’s, game consoles, DVD players and ceiling fans in all rooms. You must not move these items from their designated room. You will be charged a replacement fee or finders fee if these are not set out in plain view on the dresser, table, shelf or wall where they were when you arrived. These items are inventoried and are accounted for before your arrival and after your departure.
There is no indoor parking as the garage has been converted to a movie theater for your enjoyment, but there is parking in the paved driveway. No large vans or trucks, motorcycles, boat trailers, or recreational vehicles are permitted on the premises. NO PARKING IN THE GRASS AT ANY TIME! Only four (4) vehicles are aloud to park at the home during your stay.
The Tenant shall be solely responsible for any thefts, acts of vandalism, or other damage or loss of personal property which may occur during the course of this agreement, whether said damage or loss be the property of the Tenant or any other person invited in by the Tenant, unless such damage is specifically caused by the negligence or incompetence of the owner or the owner’s agent.
Florida Law and Ordinances / Criminal Activities:
It is your responsibility to know and understand Florida Law and local/state ordinances and follow them. The owner and Prestige Florida Villas has zero tolerance for criminal activity in and around the property. The owner and/or Prestige Florida Villas will immediately report any evidence of criminal activity to the proper authorities, and any and all guest’s engagement in any criminal activity is a default of the lease. The guest understands his/her responsibility to call the police/emergency services and report any suspicious activity observed, and then notify the owner and/or Prestige Florida Villas. The tenant understands that disturbances of the peace not only infringe on the neighbors’ peaceful enjoyment of their property, but are also a default of the lease. In the event of any criminal activity in which the guests are directly or indirectly involved, the owner and/or Prestige Florida Villas will take the legal measures necessary to evict the guests from the premises immediately. This includes but does not limit to illegal drug activity, gang involvement, organized crime and disturbances of the peace. If you or any of your guests are found to be or have violated any of these, it will result in immediate eviction and additional charges.
Liabilities and Responsibilities:
The owner and owner’s agent commit to keeping the property in its normal, safe, usable and habitable condition. In the event that the property is rendered unsafe, not usable or habitable by the local authorities and has not been caused by the Tenant’s actions, the Tenant shall immediately be relieved of his obligations under this agreement. He shall be refunded the unused portion of his rent.
In the event of equipment failure, please notify the owner or property manager for repairs or renewals. The Tenant, however, expressly waives and relinquishes any rights or claims against the owner or manager for any damage that may result to the Tenant from lack of maintenance, repair, or defect, including owner’s or manager’s ordinary negligence. All personal property of the Tenant kept on the premises is at the risk of the Tenant. There will be no refund, or part of the rental amount, for any failure of any of the equipment to work. The only exception is the pool heat, which would be refunded on a pro rata base. No refund can be made for inclement weather, water temperatures that are above 82 degrees, or for days when the pool is not in use. Please do not attempt to adjust the pool heating yourself as it is very easy to break and very expensive to fix. You will be liable for all costs for damages caused by you.
The owners and the owner’s agents do not accept liability for personal injury, accidents, loss, or damage to persons or personal effects howsoever caused.
In the event that the owner removes the property from the management program, or due to other circumstances the house is not available, then every effort will be made to find a similar property. Owner or agent should not be liable to the Tenant should similar units not become available, whereby monies paid shall be refunded. You and the members of your party agree to pay all costs including reasonable attorney’s fees incurred by the owner in enforcing, by legal proceedings or otherwise, the terms of this lease.
Each member of your party hereby knowingly, voluntarily, and intentionally waives any right each party may have to a trial by jury with respect to any litigation arising out of, under, or in connection with this lease.
Joint and Several Liability:
All Guests and owners shall be jointly and severally liable for all terms and conditions set forth in this agreement.
While we endeavor to give a high level of service to our guests, any issues or problems regarding your vacation stay must be dealt with prior to departure. Under no circumstances will these be addressed after your vacation stay.
Check Out Procedure
1. You must depart no later than 10:00 a.m. unless you have made prior written arrangements.
2. Pool enclosure deck must be free of debris/trash and food.
3. If you rented the grill you must clean grill and replace grill cover per instructions in lease. You MUST lock the grill lid before departure.
4. Kitchen must be left clean and orderly, no dirty dishes, ovens, microwave ovens, small appliances or stoves. All kitchenware/dishes must be cleaned and return to the appropriate cabinet/drawer before your departure. You must use dishwasher soap/detergent for the dishwasher and dishwashing soap/detergent for hand washing kitchen items.
5. Before departure, strip beds of their sheets & pillow cases and leave in front of the washer/dryer area. Start a load of towels before you leave so they are ready for the cleaning staff to place in dryer. You MUST use laundry soap/detergent for this load of laundry.
6. The floors should be broom clean.
7. All trash/garbage must be bagged and left outside in trash container ready to dispose of. You must take all trash that does not fit in the trash container to the trash compactor located at the front of the resort. You may ask the clubhouse or security personal for help in locating the trash compactor. Garbage containers are provided at the side of the house.
8. All television remote controls, game controller, other device remotes and ceiling fan remotes must be set out in plain view on the dresser, table, shelf or wall where they were when you arrived.
9. All exterior doors and windows must be locked and secured. Please shut off all lights and do not leave any water faucets on.
You agree that the person signing this lease is the same person listed on the credit card used for this transaction to secure your reservation. You must submit a valid drivers license or state issued photo id and the full address, name and telephone number of the credit card holder that was used for this transaction. All information below must be submited before your check-in information will be sent. We ask that you submit this immediately. It must be submitted no later than one week before arrival so we can process you information and there will be no delay upon your arrival.
