This Short Term Rental Agreement (the "Agreement") is made by and between:

Rick Dyer ("Homeowner" or “owner” or “Owner”), and the short-term vacation traveler hereinafter (referred to as “Guest” or “You” or “you”),

“House” or “house” shall mean and/or refer to the Main House and/or the separate attached Guest house located at 1765 Whispering Pines Drive. Julian CA.

For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

The property is located at: 1765 Whispering Pines Drive Dr, Julian CA 92036
The property is furnished including one 55” UHD 4K TV, 8’ Projection Television and Sound System and Blu-Ray player, a limited number of movies, linens, towels, cooking utensils, plates and cups, built-in microwave, stove/range, refrigerator, dishwasher, coffee maker, toaster, full kitchen, etc.

The rental party shall consist of Guest and a maximum of ten (10) additional persons in the Main House as stated in writing by Guest on (SENSITIVE CONTENTS HIDDEN) written communication. In the event the Guest House is additionally rented then: In no case may the total number of aggregate persons in both houses exceed fourteen (14) in the total Guest rental party (including visitors).

a. The maximum number of guests is limited to ten (10) person(s) or fourteen (14) if the Guest House has been additionally rented. An additional charge of $100 per person per night may be charged for guests exceeding the maximum people (stated in Sections 2 and 3) will be assessed by Owner as reasonably determined or concluded by Owner and may be taken out of Guest security deposit and/or additionally charged to Guest.


The lease begins at 4:30 p.m. on the "Check-in Date" and
ends at 11:00 a.m. the "Checkout Date".

This property requires a two (2) night minimum stay. Longer minimum stays may be required during holiday or special periods. If a rental is taken for less than two (2) days, the guest will be charged the two-day daily rate.

Guest agrees to abide by the Rules in this Agreement at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the rules described in this Agreement.
If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately in writing.

Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.

Rental Rate: 50% Payment including taxes and security deposit shall be due upon Guest approval of this Agreement with balance due 30 days or more in advance of reservation arrival date.
The Property Damage/security deposit is refundable Providing:

a. There is no vandalism, theft or damage to Property or contents, and
b. Guest has checked out of House by 11am on the Check-out date.
c. Guest has honored all terms of this Short Term Rental Agreement.


Our refund policy is as follows:
You may cancel up to 7 days before your trip and get a 50% refund plus service fees back.
c. No refunds if: Reservation cancelled less than 7 days or after your arrival date or do not show up for your reservation or if you interrupt or cancel your vacation once it has begun.

We encourage all renters to purchase travelers insurance.

Acceptable payment methods are E-check or credit card.

12. Smoking is NOT allowed in the house or anywhere on the property. THERE IS A $250.00 FINE IF GUEST SMOKES IN THE HOUSE.

13. Pets are NOT allowed in the house or anywhere on the property.

14. People other than those in the registered Guest party set forth above may not stay overnight in or on the property. All persons in or on the property is the sole responsibility of Guest. Guest is aware of the inherent risks of renting this house on this property.

15. Guest and those who are in the guest party understand Guest assumes all responsibility and will hold Owner harmless and agrees to all of the following:
a. This house is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities.
b. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest.
c. UNSUPERVISED CHILDREN: Guest acknowledges that they have been advised that children should never be left unsupervised as windows and railings may pose a fall risk and HAZARDOUS CLEANING CHEMICALS ARE OFTEN STORED UNDER SINKS INSIDE HOME OR CABINETS IN THE HALLWAY.
d. Homeowner strongly recommends that Guest with: Children, disabled or elderly people NOT use or install a fire in the wood-burning stove or fireplace. The stove or fireplace are not adequately protected from a child or elderly person accidentally touching the hot surface. Touching the surface of a wood burning stove outdoor BBQ or fireplace can result in instant third degree burns and may require immediate medical attention.
e. Guest use of wood burning or propane stoves is at Guests' sole risk and liability and Guest agrees that Homeowner will be held harmless and not be in any way held accountable or liable for guest use or misuse of stove.
f. By accepting this reservation it is agreed that all guests are expressly assuming the risk and liability of any harm arising from their use of the premises or others whom show up on property or they invite to use or visit the premises.
g. Guest is aware of the inherent risks of renting this house on this property.
h. There are wild animals and creatures and insects including but not limited to: Snakes, mice, spiders, Mountain Lions etc. that may come reside and go in or on the property and/or throughout Julian, and Guest and those who are in the guest party are responsible to take precautions to identify and determine said risks before and when venturing on throughout and in the property and Guest assumes all responsibility and will hold Owner harmless for any incidents that may result from interaction and/or contact with any living creatures or organisms.

16. Guest will keep the property and all furnishings in good order.
17. Guest will only use appliances for their intended uses.

Parking is limited to six (6) vehicles. Vehicles are to be parked in designated parking areas on Owners property only. Parking on the road directly in front or side of the house is not permitted. Parking on the road is not permitted. Guest may not block the drive to the House. Any illegally parked cars are subject to towing and ticketing; applicable fines/towing fees are the sole responsibility of the vehicle owner. There is no additional parking nearby.

There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the house.

20. HOT TUB:
a) No children under the age of 12 permitted in hot tubs at any time without adult supervision.
b) When using the hot tub, remember there is a certain health risk associated with this facility. Use at your own risk. We routinely clean and sanitize the hot tub which may cause the water not to be warm until later in the day or evening.
c) Do not jump or dive into the Hot tub. DO NOT STAND ON THE HOT TUB COVERS. Hot tub covers are for insulation purposes and are not designed to support a person. THEY WILL BREAK and you will be charged for replacement.
d) Remember when not using the hot tub, LEAVE SPA COVER ON AND SAFETY STRAPS LOCKED DOWN so
hot tub will stay warm and help prevent and protect young children from climbing into tub and potentially drowning. If safety straps are broken missing etc. you must notify owner in writing prior to use and allow any said safety condition to be corrected or repaired in a reasonable amount of time.

Use at your own risk. Use starter balls to ignite wood in fireplace. Starter balls may be provided by the owner. Never put paper, plastics or other non-wood materials in fireplace. Outdoor fire pits or open fires are strictly forbidden.

The property is on a septic system. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper and human waste. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clog the septic system , Guest could be charged damages of up to $(PHONE NUMBER HIDDEN). SYSTEM FAILURE:
a. In case of failure of a system or amenity during your stay including but not limited to: Water, power outage, septic, electrical , mechanical , ventilating , structural systems , major and minor appliances, wi-fi internet or entertainment equipment, etc. , once notified by guest of problem Owner shall reasonably attempt to have them repaired or restored in a timely manner. You agree to permit access to the House to make repairs. We shall not be liable to You for damages, and NO REBATE OR REFUND will be given for such temporary failures; provided, We attempt to repair the system or amenity in a reasonable manner after having received notice in writing from Guest that repairs are needed.
b. No refunds will be given for highway/road/driveway conditions, traffic, storms or weather. Mountain roads can be curvy and steep. Gravel and Paved drives are maintained however; we highly recommend four wheel drive and/or chains during the snow months. We do not refund due to road conditions.
c. AMENITIES OR SERVICES OFFERED: Everything will be done to make sure that what was offered in our advertising will be in the property as described. Every attempt is made to keep the inventory and/or services as advertised. A difference in amenities or services does not entitle You to any refund of rents paid. Amenities or services may be added or removed at the owner's sole discretion. Example: We have advertised Blu-Ray DVD players; it may be out for service. That fact does not warrant any refund.

Any reservation obtained under false pretenses or misrepresentation including declared use will be subject to forfeiture of advanced payment, deposit, and/or rental money and the Guest will not be permitted to check in. Likewise, guests who have already checked in and who are found to have used the premises under false pretenses or exceeded the maximum number of persons stated in their reservation will be subject to further legal action to recoup costs which exceed the amount of the security/damage insurance or deposit. Owner may at Owner’s sole decision for any reason elect to cancel any Guest reservation by providing notification to Guest via Email at least two calendar days prior to the Guest arrival date. Owner may cancel reservation without notice in the event reservation was made less than 72 hours prior to arrival. In this event Owner will refund all money’s paid by Guest to owner. Guest shall have no recourse other than to receive a full refund of all money paid by Guest to Owner.

By sending payment in partial or full to hold a chosen date, or by pre-paying for the rent with a credit card, Guest agrees to all terms and conditions of this Agreement and further agree that 1765 Whispering Pines Drive and it's owners and representatives will be bound by the terms within this written Agreement. Guest further states that they are at least twenty-five (25) years of age and will be the principal Guest and as such will be completely responsible for the actions of other guests including any for whom may be making these arrangements.

The parties agree to the terms of this Short Term Rental Agreement
By sending partial or full payment in to hold a chosen date, or by pre-paying for the rent with a credit/debit card:

Guest agrees to all terms and conditions of this Agreement, Guest further states that they will be the principal Guest and as such will be completely responsible for the actions of any and all other persons on the property during their stay.

This home is a 'vacation' home and it is strictly forbidden to use it as/for: Loud music, drinking or party house illegal substances or to in any way disturbing the neighbors. Unreasonable noise in or from the SPA or outside home after 10 pm results in either the sheriffs being called or neighbors calling the owner.

Violation of this Section 24 gives Homeowner the right to immediately suspend the renters' stay and forfeit remaining rent. Guest and all it's parties agree to the terms of this Short Term Rental Agreement. Guest agrees to hand sign this Agreement when they arrive for check in.

Great house! Very clean and well taken care of. Loved that the house had great views and backed up to the mountains but was still very close to downtown Julian. Loved the movie theatre and back deck. Was awesome and would go back!

A beautiful house nestled in the mountains with nothing but peace and quiet and all the amenities required to lock the doors and ignore the rest of the day world. The perfect place for a romantic weekend getaway to vacate your life, relax, and enjoy the finer things in life. Highly recommended for couples.

Our time at Volcan Peak was fantastic! It couldn't have been better! We were so well accommodated for, helped in every way and the home, area, and concierge service was high above par. I couldn't be more grateful for our experience. We had a group of four at the home for a student business retreat where we ran hikes, explored the gold mine and went row boating. All thanks to the advice, input and suppprt from the teams concierge service. I HIGHLY recommend this home and service. We are blow away by the kindness. We felt so at home and ease the e tie week. So grateful for it stay. And all this home and service provided. They went well above and beyond.

My girlfriends and I spent the weekend at Ricks place to celebrate a 50th birthday and we had a wonderful time! Rick and his staff are very thorough in their run-through of the house and care a lot about their renters comfort. Great location. Five minutes from the center of Julian. Plenty of room to spread out and sleep everybody. Amenities were awesome. We didn't lack for anything. Really enjoyed the movie theater!!! That was my favorite part of the house! Beautiful location. Loved the sound of the wind whistling while we slept. If you are looking for a great family retreat then this is it!

Fantastic views and great media room! The home is very clean and comfortable, with a fully equipped kitchen. No detail is missed and the stay was absolutely perfect.
