The kitchen is well stocked and looks to the sea. There is bar seating, and the kitchen opens to the living room. The beach side deck has a BBQ and plenty of seating and lounging areas where you can watch the whales, dolphin and rays as well as the kiteboarders, windsurfers and fishermen. There is a courtyard with a lounge area and table, and the media sombre with lounge seating on the garden side of the house.

For your convenience, there are 2 beach cruisers , 2 SUPs and a tandem kayak for your use. If you would like to hit the pool or hot tub, you can walk next door for a margarita and jump in the infinity pool at the hotel. And of course, the Sea of Cortez is right outside the door, perfect for swimming, snorkeling, kayaking, kiteboarding, windsurfing, fishing and SUPing. There is a private palapa on the beach and two outdoor showers for rinsing off sand and salt.

If you ever want to leave the house, there is plenty to do in the area. The town has many great restaurants within walking distance, including a coffee shop and bars. There are tons of mountain biking trails from the house and a shop in town where you can rent bikes if you like. You can take a trip to Punta Pescadero or Cabo Pulmo for diving and snorkeling. There are hikes to local waterfalls and swimming holes. Depending on the time of year, you can take kiteboarding or windsurfing lessons, or take a boat out fishing.

RENTAL AGREEMENT

This short term Rental Agreement is made by and between Tricia Satake, the Homeowner (the “Owner”), and the Vacation Rental Guest (the “Guest”).

PROPERTY

The property rented in this agreement is known as Casa de la Playa, located at the end of Callejon Camino Real, Los Barriles, BCS, Mexico. (the “Property”).

MAXIMUM OCCUPANCY
The Guest agrees that no more than 10 persons shall occupy the Property during the Rental Period, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement.
RENTAL PERIOD

Check in: 4:00pm.
Check out: 11:00am.

Early Check in and/or Late Check Out may be accommodated with prior approval from the Owner.

RENTAL AMOUNT
The rental amount for this stay is as indicated on AirBnB confirmation.

CANCELLATION POLICY

The Rental Amount is fully refundable up to 60 days prior to arrival. If the reservation is cancelled between 60 and 30 days before arrival, 50% of the total rental amount will be refunded. Cancellations within 30 days of arrival are non-refundable.

DAMAGES

The cost of any items removed from the property or unreasonable damage caused by the Guest will be claimed against the Property Damage Deposit. Damages may include, but are not limited to lost or broken items, excessively dirty items or excessive cleaning costs resulting from the Guest’s occupation and use of the property, and damage incurred by cattle as a result of leaving the property gates open at any time.

The Guest will be responsible for any damage caused in excess of the Property Damage Deposit and will be invoiced separately.

RENTAL RULES

1. Smoking is not permitted inside the house or anywhere on the Property.

2. THE GATES MUST BE KEPT CLOSED TO KEEP THE COWS OUT OF THE YARD!

3. Use appliances only for their intended use.

4. Pets are not permitted on the Property.

5. Linens, towels, furniture and electronic devices are not permitted off the property. Beach towels, beach cruisers, SUPs and the kayak may be used off the property but must be returned and left in clean and undamaged condition.

6. Air Conditioner usage: please conserve energy during your stay. Do not leave the Air Conditioner on in rooms you are not using, while windows or sliders are open or when you leave for extended periods of time.

7. Septic: The property is on a septic system. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products, baby wipes, diapers, paper towels, or other nonorganic materials should be flushed at any time.

8. Fire Pit: There is a fire pit on the beach side of the house that may be used for small bonfires. You may ask the local Property Manager, Victor Rochin, for firewood. Keep the fire small enough so as not to catch the Palapa on fire.

HURRICANE AND TROPICAL STORM POLICY
The Rental amount will be refundable if the state or local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area" or
A "mandatory evacuation order has been given for the Tropical
Storm/Hurricane Warning" area of residence of a vacationing guest.
The day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund:
o Any unused portion of rent from a guest currently registered; o Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted; and
o Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.
CONDITION AND USE OF PROPERTY
The Property is provided in “as is” condition. The Owner shall use her best efforts to ensure the operation of all amenities in the Property, such as internet access, appliances, barbeque, bicycles and kayaks as applicable. The Owner shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible. The Owner shall not be held responsible for any power or water outages caused by the City of Los Barriles or by any conditions caused by the Guest or the Guest’s additional permitted guests. The Guest acknowledges at commencement of the rental, the property is in good and substantial repair except for any defect the Guest may report to the local Property Manager during the first 2 days of the rental. Any unsafe or dangerous condition must be reported to the Owner or to the local Property Manager immediately.

The Guest acknowledges that the use of the property is entirely at the Guest's risk. Guest acknowledges that use of amenities may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk. The Guest shall indemnify and save harmless the Owner against and from any and all expenses, costs, damages, suits, actions or liabilities arising from any and all loss of or damage to personal property, injury or death resulting from the use of the rental property, grounds, beach toys, bicycles, Stand Up Paddleboards, kayaks and other water sports equipment and beach and ocean use.

Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the Property.

The Guest shall leave the property in good condition, floors swept, dishes washed, beds stripped, all garbage disposed of appropriately in sealed garbage bags and placed in outside garbage bins.

DEFAULT
If the Guest should fail to comply with the conditions and obligations of this Agreement, the
Guest shall surrender the Property, remove all Guest’s property and belongings and leave the
Property in good order and free of damage. No refund of any portion of the Total Rental Amount shall be made. If any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
ASSIGNMENT OR SUBLEASE
The Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and included within the number of and as permitted occupants under this Agreement.

RISK OF LOSS AND INDEMNIFICATION
Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and the Owner shall not be responsible or liable for any reason whatsoever.
Guest hereby covenants and agrees to indemnify and hold harmless the Owner and their heirs, agents, owners, successors, employees and contractors from and against any and all claims, demands, losses, causes of action, damage, lawsuits, liabilities, legal fees and other actions for any damages, costs, attorney’s fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of the Guest due to any claims arising out of or relating to the Guest’s use and occupation of the Property and use and occupation by those persons invited on the Property by the Guest. Such claims shall include, but are not limited to any claims relating to destruction of property or injury to persons or loss of life sustained by the Guest or family and visitors of the Guest in or about the Property and the Guest expressly agrees to save and hold the Owner harmless in all such cases.
The Guest releases, waives, and discharges Owner from any and all liability claims, demands, or causes of action that Guest's use and occupation or Guest's invitees' use and occupation of the Property pursuant to this Rental Agreement may have, including injuries to person or property caused by the negligence of Owner. In consideration of Guest's occupation of the Property, Guest further agrees, promises, and covenants, not to sue Owner, for any injury or damage incurred as a result of Guest's occupation or other occupant(s) occupation of the Property pursuant to this Rental Agreement. The Guest understands the legal consequences of signing this rental agreement including releasing owner from all liability, promising not to sue owner and assuming all risks of occupying the property. The Guest agrees that if any portion is held invalid or unenforceable, the Guest will continue to be bound by the remaining terms.

The Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.
ENTRY AND INSPECTION
The Owner reserves the right for the Owner or the Local Property Manager to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or repairing the Property. If the Owner or the Local Property Manager has a reasonable belief that there is imminent danger to any person or property, the Owner or the Local Property Manager may enter the Property without advance notice.
NO WAIVER
The failure of Owner to enforce any term of this Agreement shall not be deemed a waiver.

The Guest assumes full responsibility for fulfilling the terms of the rental for the period stated.

We had a simply spectacular experience during our one-week stay in this beautiful home, and Tricia and her on-site caretaker Victor were both incredibly helpful, responsive and attentive. The photos are very accurate, and yet we still were awed when we arrived - it's even more beautiful in person! The beds are incredibly comfortable with high-quality mattresses, pillows and linens. The view is gorgeous, and the beauty of the sunrises will make you smile for the rest of the day. The kitchen is very well stocked with everything you might want to prepare your meals - good pots and pans, knives, utensils and more. If you like to cook, you'll be in your happy place. We made full use of the bikes, kayak and SUPs and spent a lot of time hanging out in the water. We loved getting cocktails and appetizers at the hotel next door (and never heard a peep of sound from that direction - it is as quiet as promised). This home is very well-suited for adult couples/friends traveling together, the master bedroom has a king bed, two rooms have a queen bed, and only one room has multiple beds (two fulls), so no one has to draw the short straw and stay in bunk beds. Of course, it would be great for families w/ kids too, but I loved that it was perfect for adult travelers. Don't hesitate to book this home, you will love it and you will have the most attentive hosts as well.
